This course equips participants with the skills to guide and refer clients in legal enquiries within a South African context. Course Outline

Day 1: Introduction to Legal Enquiries and the South African Legal System

Objectives:
• Understand the role of a guide in legal enquiries.
• Identify the structure of the South African legal system.
• Recognise key legal terminology relevant to client referrals.
• Differentiate between criminal, civil, and customary law.

Topics:
• Overview of the South African legal system.
• Sources of law: Constitution, legislation, common law, case law.
• Key legal terms: plaintiff, defendant, affidavit, summons.
• The hierarchy of courts: Magistrates, High Court, Supreme Court of Appeal, Constitutional Court.
• Introduction to legal aid and pro bono services.
• Ethical considerations when handling legal enquiries.
• Client rights and responsibilities in legal matters.

Day 2: Understanding Client Needs and Legal Issues

Objectives:
• Develop active listening skills to identify client legal needs.
• Categorise common legal enquiries (family, labour, consumer, etc.).
• Assess urgency and complexity of legal issues.
• Apply principles of confidentiality and informed consent.

Topics:
• Techniques for effective client interviews.
• Common legal enquiries: divorce, child maintenance, unfair dismissal, debt collection.
• Assessing legal needs: urgency, jurisdiction, and limitation periods.
• Informed consent and confidentiality requirements.
• Documenting client information accurately.
• Recognising when a matter is beyond your scope and requires referral.

Day 3: Referral Networks and Resources

Objectives:
• Identify appropriate legal referral sources (attorneys, Legal Aid, advice offices).
• Build and maintain a referral directory.
• Understand the role of paralegals and community advice offices.
• Evaluate the credibility and specialisation of legal practitioners.

Topics:
• Types of legal service providers: private attorneys, Legal Aid SA, university law clinics.
• Community advice offices and paralegal services.
• Creating a referral directory: criteria for inclusion.
• Referral protocols: when to refer and how to hand over.
• Networking with legal professionals.
• Referral documentation and follow-up procedures.
• Ethical issues in referrals: conflicts of interest, fees, and kickbacks.

Day 4: Legal Documentation and Record-Keeping

Objectives:
• Complete referral forms and client intake documents correctly.
• Maintain accurate case files and records.
• Understand data protection laws (POPIA) in record-keeping.
• Prepare basic legal correspondence for referrals.

• Standard referral forms and templates.
• Client intake and consent forms.
• Record-keeping systems: manual and electronic.
• Protection of Personal Information Act (POPIA) compliance.
• Writing referral letters and summaries.
• Confidentiality in documentation.
• Filing and retrieval procedures.

Day 5: Communication and Interpersonal Skills for Legal Referrals

Objectives:
• Communicate legal information clearly to clients with varying literacy levels.
• Manage client expectations regarding legal processes.
• Handle difficult or emotional clients professionally.
• Use plain language to explain legal concepts.

Topics:
• Communication barriers: language, culture, literacy.
• Techniques for explaining legal procedures simply.
• Managing expectations: timelines, costs, outcomes.
• Dealing with distressed or aggressive clients.
• Cross-cultural communication in legal contexts.
• Role-play exercises: client consultations.
• Feedback and reflection on communication skills.

Day 6: Legal Ethics and Professional Boundaries

Objectives:
• Apply ethical principles specific to legal guiding and referral.
• Recognise and avoid unauthorised legal practice.
• Maintain professional boundaries with clients.
• Understand the code of conduct for legal support workers.

Topics:
• Ethical framework: integrity, honesty, confidentiality.
• Unauthorised practice of law: what you can and cannot do.
• Professional boundaries: dual relationships, self-disclosure.
• Code of conduct for paralegals and legal advisors.
• Handling conflicts of interest.
• Reporting unethical behaviour.
• Case studies on ethical dilemmas.

Day 7: Integration, Assessment, and Action Plan

Objectives:
• Synthesise all learning into a comprehensive referral process.
• Complete a simulated referral scenario from intake to follow-up.
• Develop a personal action plan for ongoing professional development.
• Demonstrate competence through a summative assessment.

Topics:
• Review of key concepts from Days 1-6.
• Simulated scenario: client with a complex legal enquiry.
• Step-by-step referral process: assess, refer, follow up.
• Summative assessment: written test and practical role-play.
• Feedback and improvement strategies.
• Creating a professional development plan.
• Resources for continued learning: SAQA, legal journals, workshops.
• Course evaluation and certification.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
