This course equips legal professionals with the procedural knowledge and practical skills required to conduct inquest investigations in accordance with South African law. Participants will learn to gather and analyze evidence, interview witnesses, and compile reports that meet legal standards. The course ensures compliance with the Inquests Act and related regulations, enhancing the quality of investigations.

Target Audience

This course is designed for legal practitioners, including attorneys, advocates, paralegals, and legal advisors, who are involved in or responsible for conducting inquest investigations.

Prerequisites

None — open enrollment. However, a basic understanding of South African legal principles is recommended.

Course Outline

Day 1: Foundations of Inquest Investigations

Objectives:
• Understand the legal framework governing inquest proceedings in South Africa
• Identify the roles and responsibilities of legal professionals during an inquest
• Distinguish between inquests, criminal trials, and other judicial inquiries
• Describe the procedural steps from notification to conclusion of an inquest
• Recognise the importance of evidence collection and preservation in inquests

• Overview of the Inquests Act and relevant case law
• Legal definitions: unnatural death, sudden death, and reportable death
• The role of the magistrate, prosecutor, and legal representatives
• Differences between inquests and criminal proceedings
• Initial notification procedures and jurisdiction
• Evidence gathering: medical reports, scene documentation, and witness statements
• Chain of custody and exhibit management
• Ethical considerations for legal professionals in inquests

Day 2: Evidence Management and Witness Handling

Objectives:
• Evaluate different types of evidence admissible in inquest proceedings
• Apply rules of evidence to forensic and documentary exhibits
• Demonstrate effective witness examination techniques for inquests
• Analyse post-mortem reports and forensic evidence for relevance
• Prepare comprehensive summaries of evidence for the presiding officer

• Admissibility of hearsay, opinion, and documentary evidence
• Forensic evidence: autopsies, toxicology, and ballistic reports
• Examination-in-chief, cross-examination, and re-examination in inquests
• Handling expert witnesses: medical practitioners, forensic analysts
• Privilege and confidentiality issues
• Creating evidence bundles and chronologies
• Dealing with vulnerable witnesses and family participation
• Practical exercise: drafting a witness examination plan

Day 3: Procedure, Findings, and Reporting

Objectives:
• Outline the procedural steps from opening to closing of an inquest
• Draft findings and recommendations in accordance with legal requirements
• Understand the role of the Director of Public Prosecutions in reviewing inquest outcomes
• Apply procedural rules to mock inquest scenarios
• Critically evaluate inquest outcomes and identify areas for reform

• Review and appeal processes for inquest findings
• Record-keeping and reporting obligations

Overview

The practicals are designed to give legal professionals hands-on experience in handling evidence, conducting witness examinations, and participating in a simulated inquest hearing. These exercises bridge theory and practice, reinforcing procedural and evidentiary skills in a controlled environment.

Practical Activities
  • Evidence Bundle Compilation — Learners receive a case file and must compile an evidence bundle, including medical reports, scene photos, and witness statements, ensuring proper indexing and chain of custody documentation. (2h)
  • Witness Examination Simulation — In pairs, learners conduct examination-in-chief and cross-examination of a witness (played by an actor) based on a simulated death scenario, with feedback from the facilitator. (3h)
  • Mock Inquest Hearing — A full mock inquest is conducted with learners taking roles as magistrate, prosecutor, legal representatives, and witnesses, culminating in the delivery of findings and recommendations. (4h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
