Description

This course equips learners with a foundational understanding of employment rights, responsibilities, grievance procedures, and dispute resolution mechanisms in the South African workplace. It aims to foster fair labour practices and enable employees and employers to handle conflicts constructively within the legal framework.

Learning Outcomes

  • Explain the basic rights and responsibilities of employers and employees under South African labour law.
  • Apply the principles of the Labour Relations Act to identify and address unfair labour practices.
  • Demonstrate the correct procedure for lodging and managing a grievance in the workplace.
  • Analyze a workplace dispute and propose appropriate resolution methods, including mediation and arbitration.
  • Evaluate the role of the Commission for Conciliation, Mediation and Arbitration (CCMA) in dispute resolution.

Target Audience

This course is designed for employees, supervisors, union representatives, and HR practitioners who need to understand basic employment rights and grievance procedures in South Africa.

Course Outline

Day 1: Understanding Employment Rights, Responsibilities, and Grievance Procedures

Objectives:
• Identify key employment rights and responsibilities under South African labour law.
• Explain the purpose and process of grievance and dispute resolution.
• Apply basic steps to raise and resolve a workplace grievance.
• Understand the role of the CCMA and other dispute resolution bodies.
• Demonstrate knowledge of fair dismissal and disciplinary procedures.

Topics:
• Overview of South African labour legislation (BCEA, LRA, EEA).
• Employee rights: fair treatment, working hours, leave, and remuneration.
• Employer responsibilities: compliance, health and safety, and fair discipline.
• Grievance procedures: definitions, steps, and documentation.
• Dispute resolution: internal processes, CCMA, and labour courts.
• Unfair dismissal and disciplinary codes.
• Case studies on common grievances and disputes.
• Role-play: handling a grievance step-by-step.

3 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions reinforce understanding of grievance and dispute resolution processes through role-play and case analysis. Learners practice drafting grievance letters and participating in mock hearings to build confidence in applying procedures.

Practical Activities
  • Role-Play: Grievance Procedure — Learners simulate a workplace grievance scenario, taking turns as employee, manager, and HR representative to follow the grievance steps. (1h)
  • Case Study Analysis: Dispute Resolution — Learners analyse a dispute case, identify the issues, and propose a resolution pathway including CCMA referral if applicable. (1h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

All marks are recorded on the AATICD LMS and visible to each learner under their account.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
