Target Audience

This course is designed for individuals working or aspiring to work as paralegals in law firms, corporate legal departments, or public sector organisations. It is also suitable for legal support staff seeking to formalise their knowledge of fundamental legal principles.

Prerequisites

None — open enrollment. However, a basic understanding of the South African legal system is recommended.

Course Outline

Day 1: Introduction to the South African Legal System

Objectives:
• Understand the structure and sources of South African law.
• Identify the hierarchy of courts and their jurisdictions.
• Explain the role of the Constitution as the supreme law.
• Define key legal terminology used in the paralegal sector.

Topics:
• Overview of the South African legal system.
• Sources of law: Constitution, legislation, common law, custom, case law.
• Court structure: Constitutional Court, Supreme Court of Appeal, High Courts, Magistrates' Courts.
• Key legal terminology: plaintiff, defendant, appellant, respondent, jurisdiction.
• Introduction to the paralegal profession and ethical considerations.

Day 2: Constitutional Law and Human Rights

Objectives:
• Explain the supremacy of the Constitution and the Bill of Rights.
• Identify fundamental human rights and their application.
• Understand the role of the Constitutional Court in protecting rights.
• Discuss the impact of constitutional values on legal practice.

Topics:
• The Constitution of the Republic of South Africa, 1996.
• The Bill of Rights: rights to equality, dignity, freedom of expression, etc.
• Limitation of rights and the limitation clause.
• Application of the Bill of Rights to vertical and horizontal disputes.
• Case law examples: landmark Constitutional Court decisions.

Day 3: Sources of Law and Legal Interpretation

Objectives:
• Distinguish between primary and secondary sources of law.
• Apply rules of statutory interpretation.
• Understand the role of precedent in the common law.
• Analyse how legal texts are interpreted in practice.

Topics:
• Primary sources: legislation, case law, common law, customary law.
• Secondary sources: textbooks, journal articles, law reports.
• Statutory interpretation: literal, golden, mischief rules.
• The role of precedent (stare decisis) in South African law.
• Practical exercises in interpreting legal provisions.

Day 4: Law of Contract: Formation and Validity

Objectives:
• Identify the essential elements of a valid contract.
• Understand offer, acceptance, and consideration.
• Explain factors affecting contractual validity.
• Distinguish between void, voidable, and unenforceable contracts.

Topics:
• Elements of a contract: offer, acceptance, consideration, capacity, legality, possibility.
• Offer and acceptance: communication, revocation, termination.
• Consideration and its role.
• Capacity to contract: minors, mentally ill persons, intoxicated persons.
• Legality of object and possibility of performance.

Day 5: Law of Contract: Breach and Remedies

Objectives:
• Define breach of contract and its forms.
• Identify remedies available for breach.
• Calculate damages and understand specific performance.
• Apply cancellation and restitution principles.

Topics:
• Types of breach: mora debitoris, mora creditoris, repudiation, malperformance.
• Remedies: specific performance, damages, cancellation, interdict.
• Assessment of damages: direct and consequential loss.
• Mitigation of damages.
• Case law on breach of contract.

Day 6: Law of Delict: Principles and Elements

Objectives:
• Understand the concept of delict and its elements.
• Distinguish between delict and breach of contract.
• Explain the element of fault (intention and negligence).
• Identify grounds of justification.

Topics:
• Definition and elements of a delict: act, wrongfulness, fault, causation, damage.
• Distinction between delict and crime, and delict and contract.
• Fault: dolus (intention) and culpa (negligence).
• Grounds of justification: consent, necessity, self-defence, provocation.
• Strict liability and vicarious liability.

Day 7: Law of Delict: Specific Forms and Remedies

Objectives:
• Analyse specific delicts such as defamation, nuisance, and negligence.
• Understand the concept of damages in delict.
• Apply the Aquilian action and action for pain and suffering.
• Discuss defences to delictual claims.

Topics:
• Specific delicts: defamation, injuria, negligence, nuisance.
• Aquilian action for patrimonial loss.
• Action for pain and suffering (non-patrimonial loss).
• Defences: consent, volenti non fit injuria, contributory negligence.
• Assessment of damages and apportionment of damages.

Day 8: Criminal Law: Principles and Offences

Objectives:
• Understand the elements of a crime.
• Distinguish between different categories of offences.
• Explain criminal capacity and culpability.
• Identify common crimes relevant to paralegal practice.

Topics:
• Elements of a crime: actus reus, mens rea, unlawfulness.
• Categories of offences: common law and statutory offences.
• Crimes against the person: murder, assault, robbery.
• Crimes against property: theft, fraud, malicious damage to property.
• Inchoate crimes: attempt, conspiracy, incitement.

Day 9: Criminal Procedure and Evidence

Objectives:
• Outline the stages of criminal procedure.
• Understand the rights of the accused.
• Explain rules of evidence and admissibility.
• Discuss the role of the paralegal in criminal matters.

Topics:
• Criminal procedure: arrest, bail, trial, sentencing.
• Rights of the accused: right to silence, legal representation, fair trial.
• Rules of evidence: relevance, admissibility, burden of proof.
• Types of evidence: oral, documentary, real, circumstantial.
• Paralegal's role in supporting clients and attorneys.

Day 10: Law of Property and Ownership

Objectives:
• Define property and types of ownership.
• Distinguish between movable and immovable property.
• Understand modes of acquisition of ownership.
• Explain limited real rights and possession.

Topics:
• Concept of property and ownership.
• Movable and immovable property.
• Modes of acquisition: original (occupation, accession) and derivative (delivery, registration).
• Real rights: ownership, servitudes, pledges, mortgages.
• Possession and holdership.

Day 11: Family Law and Succession

Objectives:
• Understand the legal requirements for marriage and divorce.
• Explain parental rights and responsibilities.
• Discuss the law of succession: testate and intestate.
• Identify the role of the Master of the High Court.

Topics:
• Marriage: civil, customary, religious, civil unions.
• Divorce: grounds, procedures, and consequences.
• Parental rights and responsibilities, child maintenance.
• Law of succession: wills, testate succession, intestate succession.
• Administration of deceased estates and role of the Master.

Day 12: Labour Law: Basic Principles

Objectives:
• Identify sources of labour law.
• Understand the employment relationship and rights of employees.
• Explain unfair dismissal and dispute resolution.
• Discuss the role of the CCMA and Labour Courts.

Topics:
• Sources: Labour Relations Act, Basic Conditions of Employment Act, Employment Equity Act.
• Employment contract and rights of employees.
• Unfair dismissal: substantive and procedural fairness.
• Dispute resolution: CCMA, bargaining councils, Labour Courts.
• Workplace forums and trade unions.

Day 13: Consumer Protection Law

Objectives:
• Understand the Consumer Protection Act (CPA).
• Identify consumer rights and supplier obligations.
• Explain the National Credit Act (NCA) provisions.
• Discuss enforcement mechanisms and the role of the National Consumer Commission.

Topics:
• Consumer Protection Act: purpose, scope, and consumer rights.
• Right to fair marketing, fair contract terms, and product safety.
• National Credit Act: credit agreements, disclosure, reckless lending.
• Enforcement: National Consumer Commission, Consumer Tribunal.

Day 14: Legal Ethics and Professional Conduct

• Understand ethical duties of legal professionals.
• Identify conflicts of interest and confidentiality rules.
• Explain the code of conduct for paralegals.
• Discuss disciplinary procedures for misconduct.

• Ethical principles: integrity, competence, diligence.

• Disciplinary processes and sanctions for misconduct.

Day 15: Legal Research and Writing Skills

Objectives:
• Develop skills in legal research using primary and secondary sources.
• Learn to write legal memoranda and correspondence.
• Understand citation methods and referencing.
• Apply research to practical legal problems.

• Legal research methodology: identifying issues, finding sources.
• Use of law libraries and online databases (e.g., SAFLII).
• Legal writing: memoranda, letters, affidavits.
• Citation and referencing: style guide.
• Practical exercise: drafting a legal memorandum.

Day 16: Practical Application: Case Studies and Simulations

Objectives:
• Apply legal concepts to realistic scenarios.
• Analyse case studies from different areas of law.
• Develop problem-solving skills in a paralegal context.
• Simulate client interviews and file management.

• Case study 1: Contract dispute.
• Case study 2: Delictual claim.
• Case study 3: Criminal matter.

• Simulation: client interview, drafting of legal documents.

Day 17: Integration and Assessment

Objectives:
• Synthesise all legal concepts covered.
• Complete a comprehensive assessment.
• Demonstrate competence in legal principles.
• Review feedback and plan for continued learning.

• Review of key concepts from all days.
• Integrated case study covering multiple areas.
• Written assessment: multiple choice and essay questions.
• Oral assessment: presentation of legal analysis.
• Feedback session and certificate preparation.

No practicals for this training.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
