Day 1: Introduction to the South African Legal System

Objectives:
• Understand the structure of the South African legal system
• Identify key sources of law
• Explain the hierarchy of courts
• Describe the roles of legal professionals

• Common law, statute law, and customary law
• Court hierarchy: Constitutional Court, Supreme Court of Appeal, High Courts, Magistrates' Courts
• Role of legal practitioners, prosecutors, and magistrates

Day 2: Legal Advice and Ethical Considerations

Objectives:
• Define legal advice and its boundaries
• Apply ethical principles in providing legal advice
• Recognise conflicts of interest
• Understand the Legal Practice Act

Topics:
• What constitutes legal advice
• Ethical duties of legal advisors
• Confidentiality and privilege
• Legal Practice Act 28 of 2014 provisions

Day 3: Criminal Court Processes

Objectives:
• Outline the stages of a criminal case
• Explain arrest, bail, and charge procedures
• Describe the trial process
• Understand sentencing options

Topics:
• Arrest and detention
• Bail applications
• Plea and trial
• Sentencing: fines, imprisonment, correctional supervision

Day 4: Civil Court Processes

Objectives:
• Describe the steps in a civil lawsuit
• Explain jurisdiction and forum shopping
• Understand pleadings and motions
• Outline enforcement of judgments

Topics:
• Summons and particulars of claim
• Appearance to defend and plea
• Pre-trial procedures
• Default judgment and summary judgment

Day 5: Family Law and Maintenance Court Procedures

Objectives:
• Explain divorce processes
• Describe child custody and maintenance procedures
• Understand the role of the Family Advocate
• Apply for protection orders

Topics:
• Divorce: contested vs. uncontested
• Care and contact arrangements
• Maintenance applications
• Domestic Violence Act protection orders

Day 6: Labour Court and Dispute Resolution

Objectives:
• Identify labour dispute resolution bodies
• Explain CCMA processes
• Describe unfair dismissal procedures
• Understand Labour Court appeals

• Unfair dismissal and unfair labour practices

Day 7: Magistrates' Court Practice and Procedure

• Navigate Magistrates' Court rules

• Understand civil and criminal jurisdiction
• Apply for default judgments and warrants

• Civil procedure in district and regional courts
• Criminal procedure in magistrates' courts

Day 8: High Court Practice and Procedure

Objectives:
• Differentiate High Court from lower court procedures
• Draft notices of motion and affidavits
• Understand motion proceedings vs. trial actions
• Manage case flow and roll

Day 9: Alternative Dispute Resolution (ADR)

Objectives:
• Explain mediation, arbitration, and negotiation
• Apply ADR in appropriate cases
• Understand the role of legal advisors in ADR
• Draft settlement agreements

• Arbitration: binding vs. non-binding
• Negotiation strategies

Day 10: Legal Research and Document Drafting

Objectives:
• Conduct legal research using primary and secondary sources
• Draft legal opinions and letters of advice
• Prepare court documents
• Use legal databases effectively

• Drafting: letters, affidavits, heads of argument

Day 11: Client Interviewing and Case Management

Objectives:
• Conduct effective client interviews

• Communicate legal advice clearly

• Communicating options and risks

Day 12: Integration and Practical Application

Practicals

40 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions allow learners to apply court procedures and legal advice skills in simulated environments. Learners will draft documents, participate in mock trials, and conduct client interviews under supervision.

Practical Activities
  • Mock Bail Application — Learners prepare and present a bail application in a simulated court setting, including drafting affidavits and making oral arguments. (8h)
  • Civil Trial Simulation — Learners participate in a simulated civil trial from pleadings to judgment, including discovery, pre-trial conference, and trial. (12h)
  • Client Interview and Legal Advice Role-Play — Learners conduct a client interview, identify legal issues, and provide oral and written legal advice in a realistic scenario. (8h)
  • CCMA Arbitration Role-Play — Learners simulate a CCMA arbitration hearing, presenting evidence and arguments on an unfair dismissal dispute. (6h)
  • Family Law: Protection Order Application — Learners assist a client in applying for a protection order under the Domestic Violence Act, including drafting the application and appearing in court. (6h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
