This course equips learners with the knowledge and skills required to serve process notices or documents as a Sheriff of the Court in South Africa. It covers the legal framework, procedures, and ethical considerations involved in the proper service of court documents. Participants will gain the competence to execute service efficiently and in compliance with relevant legislation.

Course Outline

Day 1: Foundations of Process Serving and Legal Framework

Objectives:
• Understand the role and responsibilities of the sheriff in serving process.
• Identify the legal framework governing process service in South Africa.
• Distinguish between different types of documents and notices.
• Recognise the importance of jurisdiction and territorial limits.

Topics:
• Overview of the Sheriff's Office and its functions.
• Legal sources: Magistrates' Courts Act, Supreme Court Act, and rules.
• Types of process: summons, subpoenas, interdicts, eviction orders.
• Jurisdiction and venue requirements.
• Key terminology: service, return of service, proof of service.
• Ethical considerations and impartiality.

Day 2: Procedures for Service of Process

Objectives:
• Describe the methods of service prescribed by law.
• Execute personal service, domicilium citandi, and substituted service.
• Understand the rules for service on legal entities and government.
• Complete the return of service accurately.

Topics:
• Personal service: requirements and execution.
• Service at domicilium citandi and chosen addresses.
• Substituted service: when and how to apply.
• Service on companies, close corporations, and trusts.
• Service on the State and public officials.
• Drafting and filing the return of service.
• Time limits and extensions.

Day 3: Special Types of Service and Challenges

Objectives:
• Handle service of urgent applications and interdicts.
• Serve documents in eviction and family law matters.
• Navigate challenges: non-compliance, refusal to accept, and dangerous environments.
• Apply rules for service outside the court's jurisdiction.

Topics:
• Urgent applications: service procedures and timing.
• Eviction orders: service requirements and notices.
• Family law: protection orders, maintenance, and custody.
• Dealing with refusal to accept service.
• Service in hazardous or restricted areas.
• Service outside jurisdiction: letters of request.
• Addressing errors and irregularities in service.

Day 4: Record-Keeping, Returns, and Court Procedures

Objectives:
• Maintain accurate records of service attempts and outcomes.
• Draft comprehensive returns of service for various scenarios.
• Understand court procedures related to proof of service.
• Respond to queries and challenges from the court or parties.

Topics:
• Logging service attempts: date, time, location, method.
• Completing the return of service form with detail.
• Affidavits supporting substituted service.
• Filing returns with the registrar or clerk.
• Court hearings: default judgments and service verification.
• Responding to enquiries from attorneys and litigants.
• Handling subpoenas for sheriff's testimony.

Day 5: Practical Integration, Ethics, and Assessment

Objectives:
• Integrate all knowledge through simulated service scenarios.
• Apply ethical decision-making in complex situations.
• Demonstrate competence in completing returns under timed conditions.
• Prepare for the unit standard assessment.

Topics:
• Role-play: personal service, substituted service, and urgent service.
• Scenario-based problem solving: difficult recipients, incorrect addresses.
• Ethics: confidentiality, impartiality, and avoiding conflicts.
• Mock assessment: complete return of service from a scenario.
• Review of key legal points and common mistakes.
• Final assessment (formative/summative).

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
