Course Outline

Day 1: Foundations of the South African Constitution and the Bill of Rights

Objectives:
• Explain the historical context and significance of the South African Constitution.
• Describe the structure and key provisions of the Bill of Rights.
• Identify the rights enshrined in Chapter 2 of the Constitution.
• Understand the application of the Bill of Rights to both public and private law.

• Historical background: Apartheid to democracy.
• Overview of the Constitution of the Republic of South Africa, 1996.
• The Bill of Rights: structure, scope, and limitations.
• Classification of rights: civil, political, socio-economic, and cultural.
• Horizontal and vertical application of the Bill of Rights.
• Introduction to constitutional interpretation principles.
• Role of the Constitutional Court and judiciary.
• Case study: landmark cases on equality and dignity.

Day 2: Substantive Rights and Limitations

Objectives:
• Analyse specific rights: equality, human dignity, freedom of expression, and socio-economic rights.
• Understand the limitation clause (Section 36) and its application.
• Evaluate the state's obligations to respect, protect, promote, and fulfil rights.
• Apply the Bill of Rights to practical scenarios involving rights conflicts.

Topics:
• Right to equality (Section 9): substantive equality and unfair discrimination.
• Human dignity (Section 10) and its link to other rights.
• Freedom of expression (Section 16) and its limitations.
• Socio-economic rights: housing, healthcare, food, water, and social security.
• Limitation analysis: law of general application, reasonableness, and proportionality.
• State obligations: negative and positive duties.
• Enforcement mechanisms: courts, Human Rights Commission, and other institutions.
• Practical exercises: analysing hypothetical violations.

Day 3: Application, Enforcement, and Integration into Practice

Objectives:
• Apply the Bill of Rights to workplace, business, and community contexts.
• Understand the role of Chapter 9 institutions in promoting rights.
• Develop skills to draft rights-compliant policies and procedures.
• Integrate constitutional principles into daily professional practice.

Topics:
• Application in employment: unfair dismissal, affirmative action, and equality.
• Business and human rights: corporate accountability and consumer rights.
• Access to justice: legal aid, public interest litigation, and class actions.
• Chapter 9 institutions: Public Protector, SAHRC, Gender Commission.
• Drafting rights-compliant policies: checklists and best practices.
• Case study: recent Constitutional Court judgments.
• Role-play: resolving rights disputes through mediation.
• Personal action plan: embedding constitutional values.

Practicals

Overview

Practicals are integrated throughout the course to apply constitutional principles to real-world scenarios. Learners engage in case analysis, group discussions, role-plays, and policy drafting exercises to develop practical skills in rights application and enforcement.

Practical Activities
  • Case Analysis Workshop — Learners analyse landmark Constitutional Court cases, identify key rights issues, and discuss the court's reasoning and implications. (4h)
  • Rights Conflict Resolution Role-Play — In groups, learners simulate a mediation session to resolve a workplace rights dispute involving equality and freedom of expression. (4h)
  • Policy Drafting Exercise — Learners draft a rights-compliant policy (e.g., anti-discrimination or access to information) for a hypothetical organisation, incorporating constitutional requirements. (4h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
