This course equips security personnel with the legal knowledge required to operate within the South African legal framework. Learners will understand their duties, powers, and limitations under relevant legislation, enabling them to apply legal principles effectively in a security environment.
Security officers, supervisors, and managers working in the private security industry in South Africa who need to apply legal aspects in their daily operations.

Objectives:
• Understand the structure and sources of South African law
• Identify the hierarchy of courts and their jurisdictions
• Explain the role of the Constitution and the Bill of Rights
• Distinguish between criminal and civil law

• Overview of the legal system: common law, statute law, customary law
• The Constitution as supreme law
• The Bill of Rights and its impact on security
• Court structure: Constitutional Court, Supreme Court of Appeal, High Courts, Magistrates' Courts
• Criminal vs. civil law: key differences
• Introduction to legal terminology
Objectives:
• Define elements of a crime and common offences relevant to security
• Understand arrest procedures and the rights of an arrested person
• Explain the concept of reasonable force and self-defence
• Describe the role of a security officer in criminal proceedings
Topics:
• Elements of a crime: actus reus, mens rea
• Common offences: theft, assault, trespass, malicious damage to property
• Arrest without warrant: conditions and procedures
• Rights of arrested persons: section 35 of the Constitution
• Use of force: private defence, necessity, and proportionality
• Chain of custody and evidence handling
Objectives:
• Understand the law of delict and its application to security
• Identify contractual obligations and breach of contract
• Explain vicarious liability and employer responsibilities
• Apply principles of negligence in security scenarios
Topics:
• Law of delict: elements (conduct, wrongfulness, fault, causation, damage)
• Negligence and the reasonable person test
• Vicarious liability: employer liability for employee acts
• Contract law: offer, acceptance, terms, breach
• Liability waivers and indemnity forms
• Case studies: security-related delictual claims
Objectives:
• Understand key legislation governing the security industry
• Explain PSIRA regulations and code of conduct
• Identify requirements for the use of force and firearms
• Apply POPIA principles to security operations

• Private Security Industry Regulation Act (PSIRA): registration, conduct, penalties
• National Key Points Act and critical infrastructure protection
• Firearms Control Act: licensing, storage, and use
• Protection of Personal Information Act (POPIA): lawful processing, consent, data breaches
• Occupational Health and Safety Act: duties of employers and employees
• Minimum standards for security training
Objectives:
• Apply legal principles to realistic security scenarios
• Analyse case law relevant to security operations
• Develop protocols for legal compliance in daily duties
• Prepare incident reports with legal considerations
Topics:
• Case studies: search and seizure, use of force, arrest procedures
• Role-play: responding to a crime scene, witness statements
• Drafting incident reports: factual accuracy, legal language
• Ethical dilemmas and decision-making frameworks

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.
Each delegate is assessed continuously throughout the course and a final summative test at the end.
Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.
On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.
