Description

This course equips learners with the competencies to administer the loss management and civil claim process within a corporate environment. Participants will gain practical skills to identify, document, and manage losses, as well as to process civil claims in compliance with relevant policies and legislative requirements.

Course Outline

Day 1: Introduction to Loss Management and Legal Framework

Objectives:
• Understand the principles and importance of loss management.
• Identify the legal and regulatory framework governing civil claims in South Africa.
• Differentiate between criminal and civil liability.
• Recognise the roles of key stakeholders in loss management.

Topics:
• Definition and scope of loss management.
• Overview of relevant legislation: CPA, NCA, and common law.
• Distinction between criminal and civil proceedings.
• Key stakeholders: insurers, loss adjusters, legal practitioners, and claimants.
• Ethical considerations in loss management.
• Case study: Real-world loss scenario.

Day 2: Civil Claim Administration Processes

Objectives:
• Outline the lifecycle of a civil claim.
• Explain the documentation required for claim initiation.
• Describe the process of claim investigation and evidence gathering.
• Understand the role of negotiation and settlement.

Topics:
• Stages of civil claim: notification, investigation, evaluation, negotiation, settlement or litigation.
• Claim forms, contracts, and supporting documents.
• Evidence collection: witness statements, expert reports, and physical evidence.
• Techniques for effective negotiation.
• Settlement agreements and their legal implications.
• Practical exercise: Completing a claim form.

Day 3: Loss Assessment and Quantification

Objectives:
• Apply methods for assessing different types of loss.
• Calculate quantum of damages for various claims.
• Understand the principles of subrogation and salvage.
• Evaluate the impact of contributory negligence.

Topics:
• Types of loss: property damage, business interruption, personal injury, and liability.
• Methods of loss assessment: cost approach, market approach, income approach.
• Quantum calculation: special and general damages.
• Subrogation: rights and processes.
• Salvage and its role in loss reduction.
• Contributory negligence and apportionment of damages.
• Practical exercise: Quantum calculation scenario.

Day 4: Litigation and Dispute Resolution

Objectives:
• Understand the litigation process in civil claims.
• Explore alternative dispute resolution mechanisms.
• Prepare for trial and understand court procedures.
• Analyse case law relevant to loss management.

Topics:
• Steps in litigation: summons, pleadings, discovery, pre-trial conference, trial.
• ADR: mediation, arbitration, and conciliation.
• Role of expert witnesses.
• Court etiquette and presentation of evidence.
• Review of key case law on loss and damages.
• Practical exercise: Simulated mediation session.

Day 5: Advanced Applications and Integration

Objectives:
• Synthesise knowledge to manage complex claims.
• Develop strategies for fraud detection and prevention.
• Apply loss management principles in a simulated work environment.
• Evaluate the effectiveness of loss management systems.

Topics:
• Managing complex claims: multiple parties, cross-border issues, and high-value losses.
• Fraud indicators and investigation techniques.
• Implementing loss management frameworks in organisations.
• Performance metrics and continuous improvement.
• Case study: Comprehensive claim management.
• Final assessment: Integrated scenario exercise.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
