This course equips learners with a comprehensive understanding of South African fisheries law and international conventions governing marine resource management. Participants will gain the knowledge and skills to ensure compliance with the Marine Living Resources Act, relevant regulations, and international agreements such as UNCLOS and FAO compliance measures.

Course Outline

Day 1: Introduction to South African Fisheries Law and International Conventions

Objectives:
• Understand the scope and importance of fisheries law in South Africa
• Identify key international conventions relevant to fisheries management
• Explain the relationship between national legislation and international obligations
• Recognize the role of compliance in sustainable fisheries

• Overview of South African fisheries: economic, social, and ecological significance
• Sources of fisheries law: statutes, regulations, and customary law
• Key international conventions: UNCLOS, UNFSA, and FAO compliance agreement
• Introduction to the Marine Living Resources Act (MLRA) of 1998
• Institutional framework: Department of Forestry, Fisheries and the Environment (DFFE)
• The concept of flag State, coastal State, and port State responsibilities
• Overview of compliance mechanisms: monitoring, control, and surveillance

Day 2: The Marine Living Resources Act (MLRA) and Regulations

Objectives:
• Explain the key provisions of the MLRA
• Distinguish between different types of fishing rights and permits
• Describe the process for allocating fishing rights
• Identify prohibited activities and penalties under the MLRA

Topics:
• Structure of the MLRA: objectives, definitions, and application
• Fishing rights allocation: commercial, recreational, subsistence, and small-scale
• Permit systems and conditions
• Total Allowable Catch (TAC) and Total Allowable Effort (TAE)
• Prohibited activities: illegal fishing, use of prohibited gear, fishing in closed areas
• Offences, penalties, and enforcement provisions
• Regulations: vessel licensing, catch reporting, and gear restrictions
• Case study: recent amendments to the MLRA

Day 3: International Fisheries Law and Conventions

Objectives:
• Understand the key provisions of UNCLOS related to fisheries
• Explain the role of RFMOs in fisheries management
• Describe the requirements of the FAO Port State Measures Agreement
• Analyze the impact of international law on South African fisheries

Topics:
• UNCLOS: exclusive economic zones, high seas, and straddling stocks
• UN Fish Stocks Agreement (UNFSA): conservation and management
• Regional Fisheries Management Organizations (RFMOs): ICCAT, SEAFO, etc.
• FAO Compliance Agreement and Port State Measures Agreement (PSMA)
• International Plan of Action (IPOA) for Illegal, Unreported and Unregulated (IUU) fishing
• South Africa's obligations under CITES for listed marine species
• The role of the International Tribunal for the Law of the Sea (ITLOS)

Day 4: Compliance and Enforcement Mechanisms

Objectives:
• Describe the monitoring, control, and surveillance (MCS) framework in South Africa
• Explain the role of inspections and observers
• Understand the legal procedures for enforcement actions
• Identify the challenges in fisheries compliance

Day 6: Trade, Traceability, and Seafood Supply Chain Compliance

Objectives:
• Understand the requirements for legal seafood trade under South African and international law
• Explain catch documentation schemes and traceability
• Identify the role of customs and border control in fisheries compliance
• Analyze the impact of trade measures on IUU fishing

• Catch certification and documentation schemes: requirements under EU IUU Regulation
• Traceability systems: from catch to consumer
• Customs controls and import/export permits
• The role of the South African Revenue Service (SARS) in fisheries trade

Day 7: Practical Integration, Case Studies, and Assessment

Overview

The practicals component reinforces theoretical knowledge through simulated inspections, document analysis, and case-based problem-solving. Learners engage in hands-on exercises that mirror real compliance tasks, such as inspecting fishing gear, verifying catch documentation, and conducting mock port state control inspections.

Practical Activities
  • Practical 1: Fishing Gear Identification and Compliance Check — Learners examine various types of fishing gear (e.g., gillnets, trawls, longlines) and identify compliance issues such as mesh size violations or missing turtle excluder devices. (5h)
  • Practical 2: Catch Documentation and Traceability Exercise — Learners review sample catch documents, logbooks, and landing declarations to verify accuracy and traceability from vessel to market. (5h)
  • Practical 3: Mock Port State Control Inspection — Learners conduct a simulated port inspection of a fishing vessel, including checking licenses, gear, catch, and vessel documentation, followed by a debrief. (6h)
  • Practical 4: IUU Incident Case Analysis and Response — Learners analyze a complex IUU fishing scenario, identify legal breaches, and develop a response plan including evidence gathering and prosecution steps. (5h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.
