Course Outline

Day 1: Foundational Legal Principles in the Sheriff's Environment

Objectives:
• Understand the constitutional and statutory framework governing the sheriff's office.
• Identify the key legislation impacting sheriff duties.
• Explain the hierarchy of laws and their application.
• Recognize the role of the sheriff in the justice system.

Day 2: Jurisdiction and Authority of the Sheriff

Objectives:
• Define jurisdiction and its limits in sheriff operations.
• Distinguish between territorial and subject-matter jurisdiction.
• Apply jurisdictional rules to service of process.
• Analyze scenarios involving jurisdictional challenges.

• Types of jurisdiction: territorial, personal, subject-matter
• Jurisdictional limits for service of civil process
• Execution of warrants within and outside jurisdiction
• Inter-provincial service and cross-border issues
• Case law on jurisdictional disputes

Day 3: Service of Process – Law and Procedure

Objectives:
• Explain the legal requirements for valid service of process.
• Describe methods of service and their applicability.
• Identify defects in service and consequences.
• Draft returns of service correctly.

• Modes of service: personal, domicilium, substituted, edictal
• Timeframes and extensions for service
• Service on legal persons, minors, and unreachable parties
• Return of service: content and evidentiary value
• Consequences of non-compliance with service rules

Day 4: Attachment and Seizure – Legal Framework

Objectives:
• Understand the legal basis for attachment and seizure.
• Differentiate between attachment in execution and interim attachment.
• Apply rules regarding permissible property for attachment.
• Identify unlawful attachment and remedies.

• Attachment in execution: procedure and limits
• Interim attachment: requirements and court orders
• Property exempt from attachment
• Seizure of goods: inventory and custody
• Third-party claims and interpleader proceedings

Day 5: Writs and Warrants – Issuance and Execution

Objectives:
• Explain the different types of writs and warrants.
• Describe the process of issuance and execution.
• Recognize errors in writs and corrective measures.
• Apply time limits and renewal rules.

• Writs of execution, possession, and arrest
• Warrants of committal and search warrants
• Issuing authority and formal requirements
• Execution steps: notification, levy, sale in execution
• Return of warrant and accounting

Day 6: Evictions – Legal and Procedural Aspects

Objectives:
• Understand the legal framework for evictions.
• Apply the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE).
• Identify procedural steps and court orders required.
• Manage vulnerable occupiers and human rights considerations.

• PIE Act: scope and requirements
• Court orders for eviction: conditions and timeframes
• Role of the sheriff in executing eviction orders
• Notices and engagement with occupiers
• Handling of personal property and storage

Day 7: Sale in Execution – Law and Practice

Objectives:
• Describe the legal process for sale in execution.
• Calculate reserve prices and advertising requirements.
• Ensure compliance with consumer protection laws.
• Manage proceeds and distribution.

• Procedure for sale in execution: notice, advertising, auction
• Reserve price and valuation of goods
• National Credit Act implications
• Conduct of sale: rules and irregularities
• Distribution of proceeds and accounting to court

Day 8: Liability and Accountability of the Sheriff

Objectives:
• Identify sources of civil and criminal liability.
• Explain the sheriff's duty of care and standard of conduct.
• Analyze case law on sheriff negligence.
• Apply indemnity and insurance provisions.

• Civil liability: wrongful attachment, conversion, trespass
• Criminal liability: corruption, fraud, misconduct
• Duty of care: reasonable skill and diligence
• Indemnity under Sheriff's Act and fidelity insurance
• Disciplinary procedures and complaints handling

Day 9: Arrest and Detention – Legal Limits

Objectives:
• Understand the legal basis for arrest by the sheriff.
• Differentiate between arrest in civil and criminal matters.
• Apply rules regarding use of force.
• Identify unlawful arrest and remedies.

Day 10: Alternative Dispute Resolution and the Sheriff

• Explain the role of ADR in reducing sheriff workload.
• Identify mediation and arbitration processes.
• Apply settlement agreements and consent orders.
• Understand the sheriff's role in enforcing ADR outcomes.

Day 11: Ethics and Professional Conduct

Objectives:
• Identify ethical dilemmas in sheriff practice.
• Apply the Code of Conduct for sheriffs.
• Manage conflicts of interest and confidentiality.
• Understand disciplinary consequences of unethical behaviour.

Day 12: Emerging Legal Issues and Practical Integration

Practicals

36 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions allow learners to apply legal procedures in simulated sheriff operations, including drafting returns, conducting mock attachments, and executing eviction scenarios. These hands-on exercises reinforce theoretical knowledge and develop competence in real-world applications.

Practical Activities
  • Practical 1: Drafting Returns of Service — Learners draft accurate returns of service for various scenarios, including personal, substituted, and edictal service, and review for compliance with legal requirements. (8h)
  • Practical 2: Mock Attachment and Seizure Exercise — Learners simulate the attachment of movable property, including inventory-taking, valuation, and handling third-party claims, in a controlled environment. (10h)
  • Practical 3: Eviction Process Simulation — Learners role-play the eviction process from receipt of court order to execution, including notice delivery, property handover, and storage of goods. (10h)
  • Practical 4: Conducting a Sale in Execution — Learners organize and conduct a mock auction, including advertising, reserve price setting, bidding, and distribution of proceeds. (8h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
