Day 2: Drafting and Interpreting Housing Contracts

Objectives:
• Learn the structure and key clauses of housing contracts.
• Develop skills to draft clear and legally compliant contracts.
• Interpret contract terms and conditions accurately.
• Identify clauses that require special attention.

• Anatomy of a housing contract: preamble, definitions, operative clauses, and schedules.
• Key clauses: purchase price, deposit, guarantees, voetstoots, and suspensive conditions.
• Drafting techniques for clarity and enforceability.
• Interpreting ambiguous terms and conditions.
• Case studies on contract interpretation disputes.
• Role of the Property Practitioners Act in contract drafting.

Day 3: Legal Requirements and Compliance Documentation

• Understand the mandatory documentation required for housing contracts.
• Learn about disclosure obligations and compliance requirements.
• Manage property condition reports, electrical certificates, and other compliance documents.
• Ensure contracts meet legal standards.

• Required documents: title deed, rates clearance certificate, electrical compliance certificate, and gas and electric fence certificates.
• Seller’s disclosure obligations under the Property Practitioners Act.
• Homeowner's association and body corporate rules.
• Compliance with the Alienation of Land Act.

Day 4: Risk Management and Dispute Resolution

• Identify risks associated with housing contracts.
• Develop strategies to mitigate legal risks.
• Understand dispute resolution mechanisms.
• Apply knowledge to real-world scenarios.

• Common risks: non-disclosure, defects, financing issues, and fraud.
• Risk mitigation through due diligence and thorough documentation.
• Dispute resolution: negotiation, mediation, arbitration, and litigation.
• The role of the Ombud for property practitioners.
• Case studies on contract disputes and resolution.
• Best practices for record-keeping and communication.

Day 5: Practical Integration and Assessment

• Complete a comprehensive contract drafting and review exercise.
• Demonstrate understanding of legal requirements and documentation.
• Prepare for real-world application.

Overview

The practicals provide hands-on experience in drafting, reviewing, and managing housing contracts and compliance documentation. Learners will apply legal requirements to realistic scenarios, reinforcing theoretical knowledge through supervised practice.

Practical Activities
  • Contract Drafting Exercise — Learners draft a full housing sale contract based on a provided scenario, including all necessary clauses and compliance documentation. (6h)
  • Contract Review and Risk Assessment — Learners review a sample contract with intentional errors and omissions, identify risks, and recommend amendments. (4h)
  • Documentation Compliance Check — Learners verify a set of property documents for completeness and compliance with legal requirements. (3h)
  • Mock Dispute Resolution — Learners participate in a simulated dispute scenario, applying negotiation and mediation techniques to resolve a contract issue. (3h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
