Description

This course equips learners with the knowledge and skills to effectively market, sell, and lease community schemes such as sectional title complexes, homeowners' associations, and shared-interest developments. Participants will learn to apply relevant legislation, manage sales processes, and execute leasing agreements in compliance with South African property law.

Course Outline

Day 1: Introduction to Community Schemes and Regulatory Framework

Objectives:
• Understand the definition and types of community schemes in South Africa.
• Identify key legislation governing community schemes (Sectional Titles Act, STSM Act, CSOS Act).
• Explain the roles of bodies corporate, homeowners' associations, and managing agents.
• Recognise the importance of marketing, sales, and leasing within community schemes.

• Legal framework: Sectional Titles Act, STSM Act, Community Schemes Ombud Service Act.
• Governance structures: body corporate, trustees, executive committees.
• Role of the managing agent and property practitioners.
• Introduction to marketing, sales, and leasing in community schemes.
• Ethics and code of conduct for property practitioners.

Day 2: Marketing Community Schemes

Objectives:
• Develop a marketing plan tailored to a community scheme.
• Identify target markets and effective marketing channels.
• Understand the unique selling points of different community schemes.
• Apply ethical marketing practices in line with the Property Practitioners Act.

Topics:
• Market analysis: demographics, location, amenities.
• Creating a marketing plan: objectives, budget, timeline.
• Marketing channels: online listings, social media, print, open houses.
• Highlighting communal facilities and lifestyle benefits.
• Compliance with advertising regulations and the Consumer Protection Act.
• Case study: marketing a sectional title development.

Day 3: Sales Processes in Community Schemes

Objectives:
• Outline the steps in selling a unit within a community scheme.
• Understand disclosure requirements and documentation.
• Manage buyer expectations regarding rules, levies, and restrictions.
• Facilitate the sales process from listing to transfer.

Topics:
• Pre-sale preparation: valuation, compliance certificates.
• Mandate agreements and listing documentation.
• Disclosure of community scheme information: rules, financials, reserves.
• Managing buyer inquiries and show days.
• Offer to purchase and sale agreement specifics.
• Role of the conveyancer and transfer process.
• Post-sale handover to new owners.

Day 4: Leasing in Community Schemes

Objectives:
• Understand the legal requirements for leasing in community schemes.
• Draft and manage lease agreements in compliance with the Rental Housing Act.
• Handle tenant applications, deposits, and move-in procedures.
• Address disputes and terminations within the scheme's rules.

Topics:
• Lease agreement essentials: rights and obligations.
• Rules and restrictions: pets, parking, noise, alterations.
• Tenant screening and application process.
• Rental deposits and the Rental Housing Act.
• Managing lease renewals and terminations.
• Handling disputes: mediation, CSOS, tribunal.
• Eviction procedures and legal considerations.

Day 5: Practical Integration and Compliance

Objectives:
• Integrate marketing, sales, and leasing into a cohesive strategy.
• Apply compliance requirements across all functions.
• Use practical scenarios to problem-solve common challenges.
• Prepare for the unit standard assessment.

Topics:
• Case study: end-to-end process from marketing to lease/sale.
• Compliance checklist: documentation, disclosures, timelines.
• Managing difficult situations: rule breaches, levy arrears.
• Role-play: handling buyer/tenant objections.
• Review of key legal and ethical points.
• Assessment preparation and mock exam.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
