This course equips customs practitioners, trade analysts, and supply chain professionals with advanced skills to resolve complex tariff classification problems under the Harmonized System (HS). Participants will master legal interpretative rules, customs rulings, and dispute resolution techniques to ensure accurate duty calculation and regulatory compliance.

Learning Outcomes

  • Apply the General Interpretative Rules (GIRs) to classify goods with conflicting or ambiguous headings.
  • Analyze product characteristics, composition, and function to determine correct HS codes for multi-component or composite goods.
  • Evaluate customs rulings, explanatory notes, and judicial decisions to support classification arguments.
  • Design classification strategies for goods subject to anti-dumping duties, tariff preferences, or trade remedies.
  • Demonstrate proficiency in using SA Customs & Excise tariff schedules and online classification tools.
  • Implement a systematic problem-solving framework to resolve classification disputes with customs authorities.

Target Audience

Customs brokers, trade compliance officers, tariff analysts, and logistics managers who handle intricate classification issues and need to minimize risk of penalties or delays.

Prerequisites

None — open enrollment. However, learners must have access to the current SA Customs Tariff Book and a computer with internet.

Course Outline

Day 1: Foundations of Tariff Classification

Objectives:
• Understand the purpose and legal framework of the Harmonized System (HS)
• Interpret the General Rules of Interpretation (GIRs) 1-3
• Apply basic classification principles to simple goods
• Identify key resources: HS Nomenclature, Explanatory Notes, and National Tariff

• Overview of the Harmonized System and its structure
• Legal framework: Customs and Excise Act, International Convention
• The 6 General Rules of Interpretation (GIRs)
• Rule 1: Heading terms and Section/Chapter notes
• Rules 2 and 3: Incomplete goods, mixtures, and composite goods
• Using Explanatory Notes and Compendium of Classification Opinions
• Structure of the South African Tariff Book
• Practical exercises on simple goods

Day 2: Advanced GIRs and Section/Chapter Notes

Objectives:
• Apply GIRs 4-6 with confidence
• Analyse complex Section and Chapter notes
• Classify goods with multiple possible headings
• Resolve conflicts between notes and headings

• GIR 4: Classification by analogy
• GIR 5: Containers and packing materials
• GIR 6: Subheading level classification
• Deep dive: Section and Chapter notes (legal notes)
• Notes that define, exclude, or include specific goods
• Case studies on note interpretation

Day 3: Classification of Textiles and Apparel (Section XI)

Objectives:
• Apply Section XI notes and Chapter headings
• Distinguish between yarns, fabrics, and made-up articles
• Classify apparel using GIR 3(b) and Chapter 61-62 notes
• Handle composite goods and sets for retail

Day 4: Classification of Machinery and Electrical Equipment (Sections XVI-XVII)

Objectives:
• Apply Section XVI notes for multi-function machines
• Classify electrical goods under Chapter 84 vs 85
• Use GIR 3(c) for composite machines
• Understand parts classification

Day 5: Classification of Chemicals and Plastics (Sections VI-VII)

Day 6: Classification of Foodstuffs, Agricultural Products, and Wood (Sections I-IV, IX)

• Handle classification of beverages and tobacco

Day 8: Classification of Optical, Medical, and Precision Instruments (Section XVIII) and Miscellaneous Goods

• Classify optical, photographic, and medical instruments
• Apply Section XVIII notes
• Classify furniture, toys, and miscellaneous manufactured articles
• Handle classification of arms and ammunition

Day 9: Integration, Rulings, and Dispute Resolution

• Integrate all GIRs and Section/Chapter notes
• Write binding tariff rulings (BTRs)
• Dispute classification decisions with customs
• Apply advanced strategies for complex goods

• Comprehensive case studies across all sections
• Writing binding tariff rulings: format and content

Practicals

Overview

The practicals provide hands-on experience in classifying actual product samples, writing tariff rulings, and resolving classification disputes. Learners will work in groups on real-world scenarios using the South African Tariff Book and HS Nomenclature.

Practical Activities
  • Practical 1: Basic Classification of Simple Goods — Learners classify a set of 20 simple everyday items (e.g., clothing, tools, food packaging) using GIRs 1-3 and Section/Chapter notes. (6h)
  • Practical 2: Advanced Classification of Composite and Multi-Function Goods — Learners classify complex items such as multi-function machines, textile sets, and chemical mixtures, applying GIRs 3-6 and relevant notes. (6h)
  • Practical 3: Writing Binding Tariff Rulings — Each learner drafts a binding tariff ruling for a given product scenario, including legal basis, analysis, and final classification. (6h)
  • Practical 4: Dispute Resolution and Customs Audit Simulation — Teams role-play a customs dispute: one side as importer, the other as customs. They prepare arguments, review evidence, and negotiate a resolution. (6h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
