Description

This course equips participants with the practical skills and knowledge required to implement an Employment Equity (EE) programme within their organisation, ensuring compliance with the Employment Equity Act (No. 55 of 1998) and related regulations. Participants will learn to develop EE plans, conduct workplace analysis, and manage reporting processes to promote fairness and diversity in the workplace.

Course Outline

Day 1: Introduction to Employment Equity and the Legal Framework

Objectives:
• Understand the purpose and scope of the Employment Equity Act (EEA).
• Identify key definitions and concepts related to designated groups.
• Explain the roles of the Department of Employment and Labour and the CCMA.
• Recognize the consequences of non-compliance with the EEA.

• Overview of the Employment Equity Act (No. 55 of 1998).
• Key definitions: designated groups, designated employer, and unfair discrimination.
• The purpose of employment equity: redressing past imbalances.
• Relationship between the EEA, Labour Relations Act, and Skills Development Act.
• The role of the Employment Equity Commission and the CCMA.
• Penalties for non-compliance and enforcement mechanisms.

Day 2: Prohibition of Unfair Discrimination and Affirmative Action

Objectives:
• Distinguish between fair and unfair discrimination.
• Identify grounds of unfair discrimination as per Section 6(1) of the EEA.
• Explain the concept of affirmative action and its application.
• Understand the duty to eliminate unfair discrimination in the workplace.

• Defences against allegations of unfair discrimination.
• Affirmative action measures: purpose and scope.
• Medical testing and psychological assessments.

Day 3: Designated Employers and Obligations

• Define who qualifies as a designated employer.
• Outline the legal obligations of designated employers.
• Understand the requirement to consult with employees and trade unions.
• Explain the process of conducting an employment equity analysis.

• Designated employer criteria: employee threshold and annual turnover.
• Obligations: preparing and implementing an employment equity plan.
• Consultation requirements with representative trade unions and employees.
• Disclosure of information during consultation.
• Conducting a workforce profile analysis.

Day 4: Employment Equity Plans and Numerical Goals

Objectives:
• Draft an employment equity plan in compliance with the EEA.
• Set numerical goals and timetables for achieving representivity.
• Understand the difference between goals and quotas.
• Identify barriers to affirmative action and strategies to remove them.

• Components of an employment equity plan.
• Setting numerical goals: reasonable progress and representivity.
• Distinguishing goals from quotas.
• Identifying systemic barriers in policies, practices, and procedures.
• Developing action steps to eliminate barriers.

Day 5: Reporting and Compliance with the EEA

Objectives:
• Understand the annual reporting requirements for designated employers.
• Complete the Employment Equity Report (EEA2) and Income Differential Statement (EEA4).
• Explain the role of the Employment Equity Committee.
• Recognize the process of submission and deadlines.

Day 10: Monitoring, Evaluation, and Continuous Improvement

• Conduct internal audits and reviews of the employment equity plan.
• Use data to identify gaps and areas for improvement.
• Report progress to senior management and stakeholders.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.
