Description

This course equips learners with the competence to identify various types of intellectual property (IP) and manage materials effectively within a corporate environment. Participants will learn to recognize IP rights, differentiate between material types, and apply appropriate management practices to protect organizational assets.

Learning Outcomes

Target Audience

This course is designed for managers, team leaders, and administrative staff responsible for handling documentation, materials, and intellectual property in their daily operations.

Prerequisites

None — open enrollment. A basic understanding of business operations is beneficial but not required.

Course Outline

Day 1: Introduction to Intellectual Property and Materials Management

Objectives:
• Define intellectual property (IP) and its types
• Explain the importance of IP in business and innovation
• Understand the role of materials management in IP protection
• Identify key legislation governing IP in South Africa

Topics:
• What is intellectual property?
• Types of IP: patents, trademarks, copyright, trade secrets, designs
• Overview of materials management: sourcing, storage, distribution
• Link between materials management and IP protection
• Introduction to SAQA Unit Standard 252449
• South African IP legal framework: Patents Act, Copyright Act, etc.

Day 2: Patents and Patent Management

Objectives:
• Understand patent requirements and processes
• Identify patentable inventions
• Manage patent documentation and materials
• Recognize the role of materials in patent lifecycle

Topics:
• What is a patent? Criteria for patentability
• Patent application process in South Africa
• Patent specification and claims
• Patent materials: prototypes, lab notebooks, technical drawings
• Managing patent-related materials: storage, access, confidentiality
• Patent infringement and enforcement basics

Day 3: Trademarks and Brand Protection

Objectives:
• Define trademarks and their function
• Distinguish between different trademark types
• Understand trademark registration and maintenance
• Manage trademark-related materials and evidence of use

Topics:
• Trademarks: logos, names, slogans, sounds, shapes
• Trademark search and clearance
• Registration process with CIPC
• Trademark classes and goods/services
• Materials management for trademarks: specimens, packaging, marketing collateral
• Trademark infringement and brand protection strategies

Day 4: Copyright and Related Rights

Objectives:
• Explain copyright protection and duration
• Identify works eligible for copyright
• Understand copyright ownership and assignment
• Manage copyrighted materials: records, licenses, permissions

• Copyright in South Africa: literary, musical, artistic, film, sound recordings
• Exclusive rights of copyright owners
• Copyright infringement and fair use
• Copyright registration (voluntary) and notices
• Managing copyrighted materials: contracts, permissions, digital rights
• Related rights: performers' rights, moral rights

Day 5: Trade Secrets and Confidential Information

Objectives:
• Differentiate trade secrets from other IP
• Identify trade secret protection measures
• Implement confidentiality agreements and policies
• Manage confidential materials and access control

• Trade secrets: definition and examples (formulas, processes, customer lists)
• Legal protection of trade secrets: common law, contractual
• Non-disclosure agreements (NDAs): key clauses
• Materials management for trade secrets: secure storage, access logs, destruction
• Employee training on confidentiality
• Trade secret vs patent: strategic choices

Day 6: Industrial Designs and Utility Models

Objectives:
• Understand industrial design registration
• Distinguish designs from patents and trademarks
• Manage design-related materials and prototypes
• Recognize utility models (petty patents) in SA

• Registration process and requirements
• Design materials: drawings, models, samples

Day 7: IP Audit and Inventory Management

Objectives:
• Conduct an IP audit
• Create and maintain an IP inventory
• Link IP assets to physical materials
• Identify gaps and risks in IP management

• Physical materials associated with IP: prototypes, samples, media

Day 8: Materials Management Systems for IP

Objectives:
• Understand materials management principles
• Apply systems for tracking IP-related materials
• Use barcoding, RFID, and inventory software
• Ensure traceability and chain of custody

• Materials management lifecycle: procurement, storage, distribution, disposal
• Inventory control methods: FIFO, LIFO, JIT
• Technology for materials tracking: barcodes, RFID, ERP systems
• Chain of custody for sensitive IP materials
• Documentation: material requisitions, transfer forms, disposal records

Day 9: Security and Access Control for IP Materials

• Implement physical and digital security measures
• Control access to IP materials
• Develop security policies and incident response
• Understand data protection and privacy laws

• Digital security: encryption, access controls, firewalls
• Visitor and contractor management

Day 10: IP Licensing and Technology Transfer

Objectives:
• Understand IP licensing agreements
• Differentiate exclusive, non-exclusive, sole licenses
• Manage materials in technology transfer
• Evaluate royalty structures and compliance

• Licensing basics: licensor, licensee, rights granted
• Types of licenses: exclusive, non-exclusive, cross-license

Day 11: IP Enforcement and Dispute Resolution

• Gather evidence and manage materials for disputes
• Coordinate with legal teams and authorities

Day 12: Integrated IP Management and Strategic Planning

• IP portfolio management: balancing protection and costs

Overview

The practicals enable learners to apply IP identification and materials management concepts through hands-on exercises, including conducting IP audits, managing physical IP materials, and using inventory tracking systems. These sessions reinforce theoretical knowledge and build competence in real-world IP and materials handling.

Practical Activities
  • IP Audit Practical — Learners conduct a simulated IP audit on a sample company, identifying patents, trademarks, copyrights, and trade secrets, and documenting associated materials. (8h)
  • Materials Tracking and Inventory System — Learners use a barcode/RFID simulator to track IP-related materials (prototypes, documents) through receiving, storage, and dispatch, maintaining a digital inventory. (8h)
  • Confidentiality and Access Control Exercise — Learners implement physical and digital access controls for sensitive IP materials, including creating NDAs, setting up secure storage, and logging access. (8h)
  • IP Licensing and Technology Transfer Simulation — Learners role-play a licensing negotiation, prepare a materials transfer agreement, and manage the transfer of technical documentation and samples. (6h)
  • IP Enforcement Evidence Gathering — Learners simulate an infringement scenario, collect and preserve evidence (physical and digital), and document chain of custody for legal proceedings. (6h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
