Description

This course equips learners with the skills to systematically collect, classify, and document intellectual property (IP) information within an organisation. Participants will learn to identify sources of IP data, apply appropriate collection methods, and ensure records are accurate and compliant with relevant legislation.

Target Audience

This course is designed for IP administrators, legal support staff, records managers, and innovation officers who are responsible for gathering and managing intellectual property information in corporate or research environments.

Course Outline

Day 1: Introduction to Intellectual Property

Objectives:
• Define intellectual property (IP) and its importance in business and innovation.
• Distinguish between different types of IP rights.
• Understand the role of IP in the knowledge economy.
• Identify key South African IP legislation and regulatory bodies.

Topics:
• What is intellectual property?
• Overview of IP types: patents, trademarks, copyright, designs, trade secrets.
• Economic and social value of IP.
• South African IP legal framework: Companies and Intellectual Property Commission (CIPC), Copyright Act, Patents Act.
• International treaties and conventions (TRIPS, Paris Convention).

Day 2: Patents – Fundamentals and Search Strategies

Objectives:
• Understand the patent system and requirements for patentability.
• Learn how to conduct a basic patent search.
• Identify key patent databases and search tools.
• Interpret patent documents and bibliographic data.

Topics:
• Patentability criteria: novelty, inventive step, industrial applicability.
• Anatomy of a patent document: claims, description, drawings.
• Patent search strategies: keywords, IPC/CPC classification.
• Free patent databases: Espacenet, Patentscope, Google Patents.
• Recording search results and documenting findings.

Day 3: Trademarks – Fundamentals and Search Strategies

Objectives:
• Understand trademark types and functions.
• Learn how to conduct a trademark clearance search.
• Navigate trademark databases and classification systems.
• Interpret trademark search results and assess conflicts.

Topics:
• Trademark types: word marks, figurative marks, collective marks, certification marks.
• Nice Classification system.
• Trademark search strategies: exact match, phonetic, visual similarity.
• South African trademark database (CIPC e-Services).
• Evaluating likelihood of confusion and similarity.

Day 4: Copyright and Related Rights

Objectives:
• Understand copyright protection scope and duration.
• Identify works eligible for copyright.
• Learn how to search copyright registries and databases.
• Understand copyright infringement and fair use/dealing.

Topics:
• Copyrightable works: literary, musical, artistic, film, sound recordings.
• Ownership and moral rights.
• Copyright registration (voluntary) and databases.
• Searching for copyright information: WIPO, copyright offices.
• Public domain and Creative Commons licenses.

Day 5: Industrial Designs and Utility Models

Objectives:
• Understand the difference between registered and unregistered designs.
• Learn how to conduct design searches.
• Navigate design databases and classification.
• Assess design novelty and individual character.

Topics:
• Types of designs: aesthetic and functional.
• Registration requirements: novelty, individual character.
• Locarno Classification.
• Design search databases (CIPC, WIPO).
• Comparing design applications and prior art.

Day 6: Trade Secrets and Confidential Information

Objectives:
• Understand trade secret protection and its limits.
• Learn how to identify and document trade secrets.
• Understand legal remedies for misappropriation.
• Differentiate trade secrets from patents.

Topics:
• Definition and elements of a trade secret.
• Protection measures: NDAs, access controls, policies.
• Searching for trade secrets: indirect methods.
• Legal framework: common law, Protection of Personal Information Act (POPIA).
• Comparison with patent protection.

Practicals

Overview

Practical sessions provide hands-on experience in conducting IP searches using online databases, analyzing search results, and compiling IP information reports. Learners will apply search strategies to real-world scenarios, enhancing their ability to collect and evaluate IP data.

Practical Activities
  • Patent Search and Analysis — Conduct patent searches on Espacenet and Patentscope for a given technology, analyze patent documents, and prepare a patent landscape report. (12h)
  • Trademark Clearance Search — Perform trademark searches on CIPC and WIPO databases for a proposed brand name, assess conflicts, and provide a clearance opinion. (10h)
  • Copyright and Design Search Exercises — Search copyright registries and design databases for given works, identify ownership and registration status, and prepare a summary report. (8h)
  • Integrated IP Information Collection Project — Work in teams to collect IP information for a product or technology, covering patents, trademarks, designs, and trade secrets, and deliver a comprehensive IP report. (10h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
