Day 1: Foundations of Ethical and Legal Pharmaceutical Representation

Objectives:
• Understand the South African legal framework governing pharmaceutical representation.
• Identify key ethical principles and codes of conduct for pharmaceutical representatives.
• Explain the role of the Pharmaceutical Society of South Africa (PSSA) and relevant regulatory bodies.
• Distinguish between ethical marketing and prohibited practices.
• Recognize the consequences of non-compliance with legal and ethical standards.

• Overview of the Medicines and Related Substances Act (Act 101 of 1965).
• The role of SAHPRA (South African Health Products Regulatory Authority).
• Ethical codes: PSSA Code of Conduct and industry self-regulation.
• Principles of ethical marketing: accuracy, balance, and non-promotion of off-label use.
• Legal obligations: record-keeping, sampling, and reporting adverse events.

Day 2: Regulatory Compliance and Professional Practice

• Apply the provisions of the Medicines Act and related regulations to daily practice.
• Demonstrate understanding of scheduling of medicines and prescribing authority.
• Develop compliant promotional materials and interactions with healthcare professionals.
• Implement proper sampling and record-keeping procedures.
• Navigate interactions with regulatory bodies during audits and inspections.

• Regulations on promotional activities: content, disclosure, and fair balance.
• Interaction with healthcare professionals: gifts, hospitality, and sponsorship rules.

• Record-keeping and reporting: adverse events, complaints, and audits.
• Role of the Marketing Code Authority (MCA) and self-regulatory bodies.

Day 3: Advanced Applications and Professional Integrity

• Analyze complex ethical scenarios and apply decision-making frameworks.
• Integrate legal requirements with company policies and industry best practices.
• Develop strategies for maintaining ethical standards in a competitive environment.
• Prepare for continuing professional development (CPD) in pharmaceutical ethics.
• Demonstrate commitment to patient safety and public health through ethical conduct.

• Handling ethical dilemmas: off-label promotion, data privacy, and inducements.
• Building an ethical culture: leadership, training, and accountability.
• Patient-centric representation: prioritizing patient welfare over sales targets.
• Use of digital media: social media, e-detailing, and data protection (POPIA).
• CPD requirements for pharmaceutical representatives.
• Final assessment: case study analysis and presentation.
• Action plan for ethical excellence: personal and organizational strategies.

Practicals

8 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions enable learners to apply ethical and legal principles in simulated real-world scenarios. Through role-plays, document reviews, and case analyses, learners practice compliant promotional interactions, sampling procedures, and ethical decision-making.

Practical Activities
  • Role-play: Ethical Detailing Visit — Learners conduct a mock promotional visit to a healthcare professional, applying legal and ethical guidelines for content, disclosure, and fair balance. (2h)
  • Sampling and Record-Keeping Exercise — Learners process a simulated sample request, complete required documentation, and log the transaction in a compliant manner. (2h)
  • Case Study Analysis: Ethical Dilemmas — Small groups analyze complex ethical scenarios (e.g., gifts, data access, off-label queries) and present their reasoning and resolution. (2h)
  • Mock Regulatory Audit Preparation — Teams review a simulated audit checklist, gather documents, and role-play an audit interview with a regulator. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
