Description

This course equips learners with the knowledge and skills to effectively administer disciplinary and grievance procedures in accordance with organisational policy and relevant legislation. Participants will learn to manage disciplinary hearings, grievances, and related documentation while ensuring procedural fairness and legal compliance.

Course Outline

Day 1: Introduction to Labour Relations and Regulatory Framework

Objectives:
• Understand the purpose and scope of disciplinary and grievance procedures
• Identify key legislative frameworks (LRA, BCEA, EEA) and their requirements
• Recognise the roles and responsibilities of parties in the process
• Distinguish between discipline, grievance, and misconduct
• Explain the principles of procedural and substantive fairness

• Overview of South African labour law and relevant legislation
• The concept of fairness in the workplace
• Distinction between discipline, grievance, and misconduct
• Roles of employer, employee, and representatives
• Introduction to the Code of Good Practice: Dismissal
• Categories of misconduct and incapacity
• The importance of documentation and record-keeping
• Case law examples illustrating key principles

Day 2: The Disciplinary Procedure – Initiation and Investigation

Objectives:
• Initiate a disciplinary process correctly from receipt of complaint
• Conduct a thorough and impartial investigation
• Draft clear charges and notifications of disciplinary hearing
• Understand the rights of the employee during the process
• Apply the principles of procedural fairness in investigations

• Steps in the disciplinary procedure: from complaint to hearing
• Conducting investigations: gathering evidence and interviewing witnesses
• Drafting charges: specificity and clarity
• Issuing notices of disciplinary hearing: timelines and content
• Employee rights: representation, interpreter, and preparation time

Day 3: The Disciplinary Hearing and Decision-Making

Objectives:
• Conduct a disciplinary hearing in a fair and structured manner
• Evaluate evidence and apply the balance of probabilities standard
• Determine appropriate sanctions based on findings
• Document the hearing proceedings and outcomes
• Understand the appeals process

Topics:
• Structure of a disciplinary hearing: opening, evidence, arguments
• Rules of evidence and burden of proof
• Questioning techniques: examination-in-chief, cross-examination
• Deliberation and decision-making: guilty/not guilty
• Determining sanctions: verbal warning to dismissal
• Writing the outcome letter and record of proceedings
• Appeals process: grounds and procedures
• Role-play: mock disciplinary hearing

Day 4: Grievance Procedure Administration

Objectives:
• Define a grievance and distinguish it from a complaint
• Implement a step-by-step grievance procedure
• Handle grievances confidentially and fairly
• Document grievances and responses effectively
• Understand the role of the CCMA in grievance resolution

Topics:
• Definition and types of grievances
• Grievance procedure steps: lodging, investigation, response
• Confidentiality and impartiality in grievance handling
• Grievance documentation forms and registers
• Managing vexatious or frivolous grievances
• Link between grievance and disciplinary processes
• Role of the CCMA and alternative dispute resolution
• Case studies: resolving common workplace grievances

Day 5: Integration, Record-Keeping, and Practical Application

Objectives:
• Integrate disciplinary and grievance procedures into HR systems
• Maintain accurate records and registers for compliance
• Apply procedures in complex scenarios (e.g., poor performance, bullying)
• Evaluate the effectiveness of procedures and make improvements
• Prepare for external dispute resolution (CCMA, bargaining councils)

Overview

The practicals component provides hands-on experience in drafting charges, conducting mock hearings, and managing grievance documentation. Learners apply procedural steps in simulated workplace scenarios to build confidence and competence.

Practical Activities
  • Drafting Disciplinary Charges and Notices — Learners receive a case scenario and draft formal charges and a notice of disciplinary hearing, ensuring compliance with legal requirements. (4h)
  • Mock Disciplinary Hearing — Learners participate in a simulated disciplinary hearing, taking roles as chairperson, initiator, employee representative, and witnesses. (6h)
  • Grievance Handling and Documentation — Learners process a sample grievance from receipt to resolution, completing all required forms and registers. (4h)
  • Record-Keeping and File Compilation — Learners compile a complete disciplinary file and a grievance file, including all correspondence, notes, and outcomes. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
