Day 1: Introduction to Conditions of Carriage and Legal Framework

• Identify key South African legislation governing transport (NRTA, NEM:AQA, OHSA).
• Define common terms and concepts used in carriage contracts.
• Explain the role of SAQA and unit standards in transport compliance.

• Legal framework: National Road Traffic Act, environmental and safety regulations.
• Key terminology: carrier, consignor, consignee, waybill, bill of lading.
• Introduction to SAQA unit standard 252275.
• Responsibilities of parties in a transport contract.
• Consequences of non-compliance: fines, liability, reputational damage.

Day 2: Key Clauses in Conditions of Carriage

Objectives:
• Identify essential clauses in standard conditions of carriage.
• Interpret clauses related to liability, indemnity, and insurance.
• Understand limitations of liability and exclusions.
• Differentiate between domestic and cross-border carriage conditions.

Topics:
• Core clauses: scope, definitions, carrier obligations, consignor obligations.
• Liability clauses: when the carrier is liable, exceptions.
• Indemnity and insurance requirements.
• Limitation of liability: weight-based, value-based, and special declarations.
• Time limits for claims and legal action.
• Comparison of road, rail, and air carriage conditions.

Day 3: Carriage of Dangerous Goods and Special Cargo

Objectives:
• Understand regulations for dangerous goods (ADR, SANS 10228).
• Identify special cargo categories (perishables, valuables, hazardous).
• Apply conditions of carriage for dangerous goods.
• Complete required documentation for dangerous goods transport.

• Classification of dangerous goods.
• ADR and SANS 10228 requirements.
• Special cargo: temperature-sensitive, high-value, fragile, livestock.
• Additional clauses for dangerous goods: packing, labeling, segregation.
• Emergency response information.
• Documentation: dangerous goods declaration, safety data sheets.

Day 4: Carrier and Consignor Responsibilities

Objectives:
• Detail the carrier's duties: safe transport, delivery, care of goods.
• Outline consignor's duties: accurate description, proper packing, documentation.
• Understand the consignee's role and acceptance procedures.
• Identify breach of contract and remedies.

Topics:
• Carrier duties: vehicle fitness, driver competence, route compliance.
• Consignor duties: correct classification, packing, marking, documentation.
• Consignee duties: inspection, acceptance, notification of damage.
• Breach of contract: non-delivery, delay, damage, misdelivery.
• Remedies: damages, specific performance, termination.
• Practical examples of responsibility allocation.

Day 5: Documentation and Records Management

Objectives:
• Identify required documents for carriage (waybill, delivery note, invoice).
• Understand record-keeping requirements for compliance.
• Complete a waybill correctly.
• Manage electronic records and document retention.

• Essential documents: waybill, delivery note, packing list, invoice.
• Waybill details: parties, description, weight, value, special instructions.
• Electronic documentation and digital signatures.
• Record retention periods (e.g., 3 years).
• Auditing documentation for compliance.
• Case study: correcting documentation errors.

Day 6: Claims, Disputes, and Liability Limits

Objectives:
• Understand the claims process for loss, damage, or delay.
• Calculate compensation based on liability limits.
• Identify time bars and notice requirements.
• Resolve disputes through negotiation or arbitration.

• Types of claims: loss, damage, delay, misdelivery.
• Liability limits: per kg, per package, or declared value.
• Calculation of compensation: actual loss vs. limited liability.
• Time limits: notice of claim (e.g., 7 days), legal action (e.g., 1 year).
• Dispute resolution: negotiation, mediation, arbitration, court.
• Documentation required for claims.

Day 7: Insurance and Risk Management

Objectives:
• Understand types of transport insurance (carrier liability, cargo insurance).
• Assess risk factors in transport operations.
• Implement risk management strategies.
• Coordinate insurance coverage with conditions of carriage.

Topics:
• Carrier liability insurance vs. cargo insurance.
• Policy terms: coverage, exclusions, deductibles.
• Risk assessment: cargo value, route hazards, packaging.
• Risk mitigation: security, route planning, contingency plans.
• Claims process involving insurance.
• Interaction between insurance and conditions of carriage.

Day 8: Compliance Audits and Enforcement

• Understand regulatory enforcement mechanisms.
• Conduct internal compliance audits.
• Identify non-compliance and corrective actions.
• Prepare for external inspections.

• Regulatory bodies: RTIA, SAPS, environmental inspectors.

Day 9: Integration, Case Studies, and Assessment

• Complete a summative assessment.
• Develop a personal compliance action plan.

• Comprehensive case study: multi-modal transport of dangerous goods.
• Group exercise: drafting a conditions of carriage contract.

• Summative assessment (written test).

• Course closure and certification.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
