Course Outline

Day 1: Introduction to Ports and Harbours Regulatory Framework

Objectives:
• Understand the legislative landscape governing South African ports and harbours.
• Identify key national and international regulatory bodies and their roles.
• Define compliance obligations for port operators and stakeholders.
• Recognise the consequences of non-compliance.
• Outline the scope of reporting requirements.

• Overview of maritime law and port governance in South Africa.
• SAQA Unit Standard 244459 context and outcomes.
• Key legislation: National Ports Act, Merchant Shipping Act, Marine Pollution Act.
• International conventions: SOLAS, MARPOL, ISPS Code.
• Regulatory bodies: Transnet National Ports Authority, SAMSA, DMR.
• Compliance obligations for port operators, terminal operators, and ship owners.
• Introduction to reporting cycles and documentation.
• Case studies of non-compliance penalties.

Day 2: Environmental Compliance and Reporting

Objectives:
• Understand environmental regulations applicable to ports and harbours.
• Identify pollution prevention and waste management requirements.
• Learn to complete environmental compliance reports.
• Apply monitoring and auditing procedures.
• Recognise the role of environmental impact assessments.

Topics:
• MARPOL Annexes and national implementation.
• Waste reception facilities and disposal records.
• Ballast water management and reporting.
• Air emission standards and monitoring.
• Environmental management plans (EMPs) and audits.
• Reporting to authorities: DFFE, SAMSA.
• Incident reporting: spills, discharges, and non-conformances.
• Practical exercise: completing a pollution report form.

Day 3: Safety and Security Compliance

Objectives:
• Apply ISPS Code requirements for port security.
• Understand occupational health and safety (OHS) regulations.
• Conduct safety inspections and drills.
• Prepare security assessment reports.
• Implement incident reporting protocols.

Topics:
• ISPS Code: port facility security assessments and plans.
• OHS Act and port-specific safety regulations.
• Safety management systems and documentation.
• Emergency response procedures and drills.
• Reporting security incidents and breaches.
• Port facility security officer (PFSO) responsibilities.
• Practical exercise: developing a security incident report.
• Practical exercise: safety inspection checklist completion.

Day 4: Operational and Customs Compliance

Objectives:
• Understand customs and excise regulations for port operations.
• Manage cargo documentation and reporting.
• Comply with port tariff and licensing requirements.
• Implement standard operating procedures for compliance.
• Prepare operational compliance reports.

Topics:
• Customs and Excise Act: import/export declarations.
• Port tariffs, concessions, and licensing.
• Cargo handling and stowage regulations.
• Dangerous goods handling and reporting.
• Vessel traffic service (VTS) and port control.
• Reporting operational incidents: delays, damages, discrepancies.
• Practical exercise: completing a cargo manifest and customs declaration.
• Practical exercise: drafting an operational compliance report.

Day 5: Integrated Compliance Management and Reporting Systems

Objectives:
• Integrate multiple compliance streams into a cohesive system.
• Use compliance software and databases for reporting.
• Conduct internal audits and prepare for external inspections.
• Develop a compliance improvement plan.
• Demonstrate competency in reporting to regulatory bodies.

• Compliance management systems: ISO 14001, ISO 45001, ISM Code.
• Electronic reporting platforms and data management.
• Internal audit procedures and corrective actions.
• Preparing for SAMSA and TNPA inspections.
• Record keeping and document control.
• Continuous improvement and compliance culture.
• Practical exercise: mock audit and inspection.
• Final assessment: complete a consolidated compliance report.

Practicals

16 hours of practicals To be conducted online or on-campus or in-house
Overview

The practicals provide hands-on experience with regulatory forms, reporting templates, and compliance scenarios. Learners will complete sample reports, conduct mock inspections, and practice using compliance software to reinforce theoretical knowledge.

Practical Activities
  • Environmental Reporting Exercise — Learners complete a pollution incident report and a waste disposal record based on a simulated scenario. (4h)
  • Security and Safety Documentation — Learners conduct a mock security assessment and safety inspection, then draft corresponding reports. (4h)
  • Customs and Cargo Documentation — Learners process a simulated cargo shipment, completing customs declarations and a cargo manifest. (4h)
  • Integrated Compliance Audit and Reporting — Learners perform a mock internal audit using a compliance checklist and compile a consolidated report for regulatory submission. (4h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
