This course equips learners with the technical knowledge and insight to understand how the legislative and regulatory environment impacts retirement fund benefits for employees. Participants will gain the ability to apply relevant laws and regulations to ensure compliance and protect employee benefits. Course Outline

Day 1: Foundations of Retirement Fund Legislation

Objectives:
• Understand the regulatory framework governing retirement funds in South Africa.
• Identify key legislation: Pension Funds Act, Income Tax Act, and relevant regulations.
• Explain the roles of the Registrar, FSCA, and other regulatory bodies.
• Describe the legal structure and governance requirements of retirement funds.
• Recognise the impact of legislative changes on fund administration.

• Pension Funds Act (No. 24 of 1956) and amendments
• Income Tax Act provisions related to retirement funds
• Role of the Financial Sector Conduct Authority (FSCA)
• Fund governance: board of trustees, principal officer, and compliance
• Legal requirements for fund rules and benefit structures
• Introduction to default regulations and preservation requirements
• Recent legislative updates and their implications

Day 2: Benefit Calculations and Member Rights

Objectives:
• Calculate retirement fund benefits under various scenarios.
• Apply legislative provisions for withdrawals, retirements, and death benefits.
• Understand member rights regarding preservation, transfers, and access.
• Analyse the tax implications of benefit payments.
• Evaluate the impact of divorce and maintenance orders on benefits.

• Benefit calculation methods: defined benefit vs defined contribution
• Withdrawal benefits: preservation, lump sums, and transfer rules
• Retirement benefits: annuities, lump sums, and compulsory purchase
• Death benefits: section 37C of the Pension Funds Act
• Tax treatment of contributions, growth, and withdrawals
• Divorce and maintenance: section 37D deductions
• Member communication and disclosure requirements
• Complaints and dispute resolution mechanisms

Day 3: Compliance, Risk Management, and Practical Application

Objectives:
• Assess compliance requirements for fund administrators and employers.
• Identify risks related to non-compliance and mitigate them.
• Apply legislative knowledge to real-world scenarios.
• Develop strategies for effective fund governance and member education.
• Prepare for regulatory audits and reporting obligations.

• Compliance monitoring and reporting to FSCA
• Risk management: governance failures, fraud, and data protection
• Code of conduct for fund administrators
• Pension Funds Adjudicator: role and case studies
• Implementation of default regulations: preservation, portability, and annuitisation
• Member education and financial literacy initiatives
• Impact of National Treasury proposals on retirement reforms
• Case studies: applying legislation to complex scenarios

Overview

Practical sessions reinforce theoretical knowledge through hands-on exercises in benefit calculations, compliance documentation, and scenario-based problem-solving. Learners work in groups to apply legislative provisions to realistic case studies, simulating fund administration tasks.

Practical Activities
  • Benefit Calculation Workshop — Learners calculate withdrawal, retirement, and death benefits using provided fund rules and member data, applying tax and preservation rules. (3h)
  • Compliance Documentation Exercise — Learners review and complete compliance documents such as fund rule amendments, section 37C death benefit distribution forms, and reporting templates. (2h)
  • Scenario-Based Case Study Analysis — Groups analyse complex case studies involving divorce, insolvency, or multiple fund transfers, and present their legislative reasoning and benefit calculations. (3h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
