Course Outline

Day 1: Introduction to Employment Equity and the South African Context

Objectives:
• Understand the historical background and rationale for Employment Equity in South Africa.
• Explain the key provisions of the Employment Equity Act (No. 55 of 1998).
• Identify the roles and responsibilities of employers and designated groups.
• Recognise the link between Employment Equity and Corporate Social Responsibility (CSR).

Topics:
• Historical context: apartheid and workplace discrimination.
• Overview of the Employment Equity Act: purpose, scope, and designated employers.
• Key definitions: designated groups, unfair discrimination, affirmative action.
• The role of the Employment Equity Commission and Labour Court.
• Introduction to CSR and its intersection with Employment Equity.
• Case study: impact of inequity on organisational transformation.

Day 2: Understanding Unfair Discrimination and Harassment

Objectives:
• Define unfair discrimination and its prohibited grounds.
• Distinguish between direct and indirect discrimination.
• Identify workplace harassment and its forms.
• Apply legal tests for justification of discrimination.

Topics:
• Prohibited grounds: race, gender, sex, pregnancy, marital status, family responsibility, ethnic or social origin, colour, sexual orientation, age, disability, religion, HIV status, conscience, belief, political opinion, culture, language, birth.
• Direct vs. indirect discrimination.
• Harassment: sexual, racial, and other forms.
• Medical testing and psychological assessments.
• Defences and justifications: inherent requirements of the job, affirmative action.
• Practical examples and case law.

Day 3: Affirmative Action Measures and Employment Equity Plans

Objectives:
• Explain the purpose and scope of affirmative action measures.
• Develop an Employment Equity Plan (EEP) in line with legal requirements.
• Understand consultation processes and stakeholder engagement.
• Identify barriers to employment equity and strategies to remove them.

Topics:
• Affirmative action: objectives and legal framework.
• Steps to develop an EEP: analysis, goals, timetables, monitoring.
• Consultation with trade unions and employees.
• Removing barriers: recruitment, selection, promotion, retention.
• Reasonable accommodation for persons with disabilities.
• Case study: drafting an EEP for a medium-sized enterprise.

Day 4: Employment Equity Reporting and Compliance

Objectives:
• Understand the reporting requirements for designated employers.
• Complete the Employment Equity Report (EEA2/EEA4) accurately.
• Explain the role of the Employment Equity Commission in monitoring compliance.
• Identify consequences of non-compliance.

Topics:
• Designated employers: criteria and obligations.
• Report structures: EEA2 (workplace profile), EEA4 (income differentials).
• Submission deadlines and procedures.
• Compliance assessments and enforcement.
• Penalties: fines, compliance orders, naming and shaming.
• Practical workshop: completing a sample EEA2 report.

Day 5: Integration with CSR and Organisational Transformation

Objectives:
• Articulate how Employment Equity contributes to CSR and sustainable development.
• Link Employment Equity to Broad-Based Black Economic Empowerment (B-BBEE).
• Develop strategies for embedding equity into organisational culture.
• Measure the impact of equity initiatives on transformation.

Topics:
• CSR pillars: economic, social, environmental – equity as social pillar.
• B-BBEE scorecard: management control, skills development, enterprise development.
• Transformation charters and sector codes.
• Building an inclusive culture: change management and communication.
• Metrics: representation targets, retention rates, employee satisfaction.
• Case study: successful integration of EE in a CSR programme.

Day 6: Implementation Challenges and Best Practices

Objectives:
• Identify common barriers to effective Employment Equity implementation.
• Develop strategies to overcome resistance and tokenism.
• Apply best practices in talent management and succession planning.
• Evaluate the role of leadership in driving transformation.

Topics:
• Barriers: unconscious bias, lack of commitment, inadequate resources.
• Overcoming resistance: communication, training, incentives.
• Talent management: recruitment from designated groups, mentorship, career development.
• Succession planning for diversity.
• Leadership accountability and role modelling.
• Best practice examples from South African organisations.

Day 7: Monitoring, Evaluation, and Continuous Improvement

Objectives:
• Design monitoring and evaluation systems for Employment Equity.
• Use data to inform continuous improvement.
• Prepare for an Employment Equity audit.
• Create an action plan for sustained transformation.

Topics:
• Monitoring tools: dashboards, surveys, focus groups.
• Evaluation: comparing actual vs. planned targets.
• Continuous improvement: corrective actions and adjustments.
• Audit preparation: documentation, evidence, interviews.
• Reporting to management and stakeholders.
• Developing a personal action plan for implementing EE in the workplace.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
