Course Outline

Day 1: Foundations of Employment Equity and Organisational Transformation

Objectives:
• Understand the historical context and rationale for Employment Equity in South Africa
• Define key terms: designated groups, affirmative action, and substantive equality
• Explain the purpose and scope of the Employment Equity Act (EEA), No. 55 of 1998
• Identify the role of the Employment Equity Commission and Labour Court
• Recognise the link between Employment Equity and broader transformation

• Historical background: apartheid and workplace discrimination
• Overview of the Employment Equity Act: objectives and key provisions
• Definitions: designated groups, unfair discrimination, affirmative action
• The Employment Equity Commission: functions and enforcement
• Relationship between Employment Equity, B-BBEE, and transformation

Day 2: Legal Framework and Compliance Requirements

Objectives:
• Analyse the prohibition against unfair discrimination (Chapter II of EEA)
• Differentiate between fair and unfair discrimination
• Understand the requirements for affirmative action measures (Chapter III)
• Explain the duties of designated employers
• Outline the process for reporting and compliance assessments

Topics:
• Prohibition of unfair discrimination: grounds and defences
• Medical testing, psychological testing, and HIV/AIDS provisions
• Affirmative action: who qualifies and what measures are required
• Duties of designated employers: consultation, analysis, plan, report
• Compliance assessments, enforcement, and penalties for non-compliance

Day 3: Conducting Employment Equity Analysis and Developing a Plan

Objectives:
• Conduct a workforce profile analysis using designated group categories
• Identify underrepresentation and barriers to equity
• Develop Employment Equity goals and numerical targets
• Formulate an Employment Equity Plan (EEP) with timelines and strategies
• Integrate consultation with employees and trade unions

Topics:
• Workforce profile analysis: occupational levels, race, gender, disability
• Identifying barriers in policies, practices, and procedures
• Setting measurable objectives and affirmative action goals
• Components of an Employment Equity Plan: plan, timetable, budget
• Consultation process: engaging with employees and unions

Day 4: Implementation Strategies for Affirmative Action Measures

Objectives:
• Design recruitment and selection strategies to promote diversity
• Implement retention and development programmes for designated groups
• Address barriers in promotion, training, and performance management
• Ensure reasonable accommodation for persons with disabilities
• Monitor and evaluate the effectiveness of affirmative action measures

• Recruitment: outreach, inclusive job descriptions, fair selection criteria
• Retention: mentorship, career development, flexible work arrangements
• Training and skills development for designated groups
• Reasonable accommodation: definitions, examples, legal obligations
• Monitoring: indicators, reporting, and corrective actions

Day 5: Reporting, Monitoring, and Continuous Improvement

Objectives:
• Complete the Employment Equity Report (EER12/EER13) accurately
• Understand the submission deadlines and online reporting system
• Analyse progress against Employment Equity Plan targets
• Conduct internal audits and reviews of equity practices
• Implement corrective actions and continuous improvement cycles

• Online reporting via the Department of Employment and Labour portal
• Progress analysis: comparing actuals to targets, identifying gaps
• Internal auditing: reviewing policies, practices, and barriers

Day 6: Integrating Employment Equity with B-BBEE and HR Systems

Objectives:
• Link Employment Equity to B-BBEE scorecard elements (management control, skills development)
• Align Employment Equity plans with organisational HR strategies
• Integrate equity data with payroll, recruitment, and performance systems
• Develop a transformation committee and governance structure
• Communicate progress to stakeholders and manage resistance

• B-BBEE and Employment Equity: overlaps and differences
• Management control: representation at senior, middle, and junior levels
• Skills development: learnerships, internships, and bursaries for designated groups
• HR integration: systems, data flow, and reporting automation
• Governance: transformation committee, communication, change management

Day 7: Practical Application, Case Studies, and Assessment

Objectives:
• Apply knowledge to real-world scenarios through case studies
• Draft a mock Employment Equity Plan and Report
• Prepare for a Department of Employment and Labour inspection
• Develop an action plan for implementing Employment Equity in own organisation
• Assess understanding through a summative evaluation

• Mock plan and report: hands-on exercise with feedback
• Inspection readiness: documentation, interviews, and evidence
• Action planning: prioritising steps, resources, and timelines
• Summative assessment: multiple-choice, short answer, and practical tasks

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
