Course Outline

Day 1: Introduction to Intellectual Property

Objectives:
• Define intellectual property and its importance in business.
• Identify the main types of IP: patents, trademarks, copyright, and trade secrets.
• Understand the legal framework for IP protection in South Africa.

Day 2: Patent Protection

Objectives:
• Explain the requirements for patentability.
• Describe the patent application process.
• Understand patent infringement and enforcement.

• Novelty, inventive step, and industrial applicability
• Patent search and prior art
• Filing a patent application in South Africa
• Patent prosecution and grant
• Patent infringement and remedies

Day 3: Trademark Protection

Objectives:
• Differentiate between trademarks, service marks, and trade names.
• Outline the trademark registration process.
• Recognize trademark infringement and dilution.

• Types of marks: word, logo, shape, sound
• Trademark search and clearance
• Filing and registration process
• Trademark maintenance and renewal
• Infringement, passing off, and remedies

Day 4: Copyright Protection

Objectives:
• Identify works eligible for copyright.
• Explain the duration and ownership of copyright.
• Understand copyright infringement and fair use.

• Subject matter: literary, musical, artistic, film, etc.
• Originality and fixation
• Ownership and moral rights
• Duration of copyright
• Infringement and fair dealing exceptions

Day 5: Trade Secrets and Confidential Information

Objectives:
• Define trade secrets and their protection mechanisms.
• Implement confidentiality agreements and policies.
• Understand misappropriation and legal remedies.

• Protection through NDAs and employment contracts
• Security measures for confidential info

Day 6: IP Strategy and Portfolio Management

Day 7: IP Licensing and Technology Transfer

Objectives:
• Structure IP licensing agreements.

• Key clauses: royalty, territory, duration
• Negotiation strategies

Day 8: IP Enforcement and Litigation

Objectives:
• Identify enforcement mechanisms for IP rights.
• Understand the litigation process.
• Explore alternative dispute resolution options.

• Preliminary injunctions

Day 9: International IP Protection

Objectives:
• Navigate international IP treaties and conventions.
• Understand regional IP systems (e.g., EU, ARIPO).
• Develop a global IP protection strategy.

• Hague System for designs

Day 10: IP in the Digital Age

Objectives:
• Address IP challenges in digital and online environments.
• Manage IP in software, data, and AI.
• Understand digital rights management (DRM).

• Data ownership and protection
• AI-generated works and inventorship
• DRM and anti-circumvention laws

Day 11: IP Risk Management and Compliance

Objectives:
• Identify IP risks in business operations.
• Implement IP compliance programs.
• Manage IP in mergers, acquisitions, and due diligence.

• Freedom-to-operate analysis
• IP due diligence in transactions
• Employee and contractor IP policies
• Record-keeping and documentation

Day 12: Practical Integration and Case Studies

Objectives:
• Apply IP concepts to real-world scenarios.

• Present and defend IP strategies.

Practicals

Overview

Practical sessions provide hands-on experience in conducting IP searches, drafting basic IP documents, and using online databases. These exercises reinforce the theoretical concepts and prepare learners to apply IP protection tactics in real-world scenarios.

Practical Activities
  • Patent and Trademark Database Search — Learners conduct searches on patent and trademark databases to identify prior art and existing marks. (10h)
  • Drafting an IP Protection Plan — Learners develop a comprehensive IP protection plan for a hypothetical company, including strategy and risk management. (12h)
  • Simulated License Agreement Negotiation — Learners role-play as licensor and licensee to negotiate key terms of a license agreement. (10h)
  • IP Infringement Case Analysis — Learners analyze a real IP infringement case, evaluate evidence, and propose enforcement actions. (8h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
