Prerequisites

None — open enrollment. However, a basic understanding of legal terminology and practice is beneficial.

Course Outline

Day 1: Foundations of Communication in Legal Contexts

Objectives:
• Understand the role of effective communication in legal practice.
• Identify barriers to communication in legal settings.
• Recognise the principles of clear and concise legal writing.
• Explore the importance of active listening in client interactions.

Topics:
• Overview of communication models and legal application
• Barriers to effective communication (cultural, linguistic, emotional)
• Principles of clarity, conciseness, and accuracy in legal communication
• Introduction to active listening techniques
• Ethical considerations in legal communication

Day 2: Verbal Communication and Interviewing Techniques

Objectives:
• Develop skills for conducting effective client interviews.
• Apply questioning techniques to gather accurate information.
• Use paraphrasing and summarising to confirm understanding.
• Manage difficult conversations with clients and colleagues.

Topics:
• Types of questions: open, closed, leading, and probing
• Structuring a client interview: opening, information gathering, closing
• Paraphrasing and summarising for clarity
• Handling emotional clients and conflict de-escalation
• Role-play exercises on client interviews

Day 3: Non-Verbal Communication and Courtroom Presence

Objectives:
• Interpret and use body language effectively in legal settings.
• Enhance courtroom presence through posture, eye contact, and gestures.
• Understand the impact of tone of voice and pacing.
• Build rapport with clients, witnesses, and judges.

Topics:
• Elements of non-verbal communication: posture, gestures, facial expressions
• Tone, pitch, and pace of speech
• Reading non-verbal cues in clients and witnesses
• Developing confidence and authority in the courtroom
• Practical exercises in non-verbal communication

Day 4: Written Communication: Legal Drafting and Correspondence

Objectives:
• Draft clear and persuasive legal documents.
• Apply plain language principles to legal writing.
• Structure letters of advice, emails, and memoranda effectively.
• Avoid common pitfalls in legal drafting.

Topics:
• Principles of plain language in legal writing
• Structuring legal letters and emails
• Drafting clear and concise pleadings and affidavits
• Common errors in grammar, punctuation, and syntax
• Peer review and editing exercises

Day 5: Advocacy and Persuasive Communication

Objectives:
• Develop persuasive arguments for written and oral advocacy.
• Structure submissions and arguments logically.
• Use rhetorical devices appropriately.
• Handle cross-examination and questioning techniques.

Topics:
• Elements of persuasive argument: ethos, pathos, logos
• Structuring oral submissions: opening, body, closing
• Rhetorical techniques for legal advocates
• Cross-examination strategies and techniques
• Mock trial exercises

Day 6: Communication in Negotiation and Mediation

Objectives:
• Apply communication skills in negotiation and mediation contexts.
• Use active listening to identify interests and positions.
• Employ techniques for building consensus and managing conflict.
• Draft settlement agreements and mediation summaries.

Topics:
• Interest-based negotiation vs. positional bargaining
• Communication techniques for mediators: reframing, summarising
• Managing emotions and impasse in negotiations
• Drafting clear settlement terms
• Role-play negotiation scenarios

Day 7: Integration, Ethics, and Professional Practice

Objectives:
• Integrate all communication skills into a coherent professional practice.
• Apply ethical principles to communication in legal contexts.
• Develop a personal communication improvement plan.
• Evaluate communication effectiveness through feedback.

Topics:
• Ethics in legal communication: confidentiality, honesty, respect
• Giving and receiving constructive feedback
• Developing a personal communication development plan
• Case studies integrating all skills
• Final assessment and feedback session

No practicals for this training.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

All marks are recorded on the AATICD LMS and visible to each learner under their account.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).

  • If you scored under 50% you can sit the final test again at the next scheduled session at no extra cost.
