Description

This course equips sheriffs and their deputies with the knowledge and skills to identify, analyse, and manage various forms of liability arising within the sheriff's environment. Participants will learn to navigate legal, professional, and ethical obligations to minimise risk and ensure compliance with South African law.

Day 1: Introduction to Liability in the Sheriff's Environment

Objectives:

Day 2: Legal Framework Governing Sheriff Activities

• Understand the role of the Rules Board
• Identify duties imposed by the Consumer Protection Act
• Apply the Promotion of Administrative Justice Act to sheriff actions

40 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions provide hands-on experience in executing sheriff duties with a focus on liability prevention. Learners will simulate service of process, attachment, sales in execution, and evictions while applying legal requirements and risk management strategies.

Practical Activities
  • Practical 1: Service of Process Simulation — Learners practice proper service techniques using mock court documents, including personal and substituted service, and complete return of service forms. (10h)
  • Practical 2: Attachment and Inventory Exercise — Learners simulate attachment of movable and immovable property, preparing inventories, valuations, and dealing with exempt property scenarios. (10h)
  • Practical 3: Sales in Execution Role-Play — Learners conduct mock sales in execution, including advertising, conducting auctions, and handling post-sale procedures, with emphasis on avoiding liability. (10h)
  • Practical 4: Eviction Procedure and Human Rights Compliance — Learners role-play eviction scenarios, focusing on lawful execution, dealing with vulnerable occupants, and documenting the process to prevent liability. (10h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
