Day 1: Introduction to Marital Status and Legal Framework

Objectives:
• Define key terms related to marital status and legal rights.
• Identify the different marital regimes recognised in South African law.
• Explain the constitutional and statutory basis for marital rights.
• Distinguish between formal and customary marriages.

Topics:
• Overview of marital status categories: single, married, divorced, widowed
• Legal framework: Constitution of South Africa, Marriage Act, Recognition of Customary Marriages Act
• Types of marriages: civil, customary, religious, civil unions
• Marital property regimes: community of property, out of community, accrual
• Introduction to legal obligations: maintenance, inheritance, decision-making
• Role of the Department of Home Affairs and courts

Day 2: Rights and Obligations in Marriage

Objectives:
• Describe the rights and duties of spouses in a marriage.
• Analyse the impact of different property regimes on asset ownership.
• Explain the legal consequences of marriage for debt and liability.
• Discuss the rights of spouses in customary marriages.

Topics:
• Spousal duties: cohabitation, support, fidelity
• Property regimes: community of property (joint estate), out of community (separate property)
• Accrual system: calculation and application
• Liability for debts before and during marriage
• Customary marriage requirements and registration
• Legal capacity of spouses: contracts, litigation, consent

Day 3: Dissolution of Marriage and Its Legal Effects

Objectives:
• Outline the legal grounds and procedures for divorce.
• Evaluate the division of assets upon divorce.
• Explain parental rights and responsibilities after separation.
• Assess the impact of divorce on maintenance and inheritance.

Topics:
• Grounds for divorce: irretrievable breakdown, mental illness, imprisonment
• Divorce procedures: contested vs. uncontested, mediation
• Asset division: redistribution orders, forfeiture, pension interests
• Maintenance: spousal and child support, factors considered
• Parental rights and responsibilities: custody, access, guardianship
• Inheritance implications: wills, intestate succession after divorce

Day 4: Death of a Spouse and Legal Consequences

Objectives:
• Describe the rights of surviving spouses in intestate succession.
• Explain the role of wills and estate planning.
• Analyse the impact of marital property regime on inheritance.
• Discuss the legal position of surviving partners in customary unions.

Topics:
• Intestate succession: surviving spouse's share, children's rights
• Wills: execution, amendment, revocation
• Estate administration: executors, inventory, distribution
• Maintenance claims against the estate
• Customary marriage: widow's rights, levirate and sororate practices
• Tax implications: estate duty, capital gains tax

Day 5: Practical Application and Case Studies

Objectives:
• Apply legal principles to real-life scenarios involving marital status.
• Analyse case law on marital disputes and rights.
• Evaluate the impact of marital status on legal documents.
• Develop strategies for advising clients on marital legal issues.

Topics:
• Case studies: divorce settlements, estate disputes, maintenance claims
• Drafting antenuptial contracts and postnuptial agreements
• Legal documents: marriage certificates, divorce orders, wills
• Role of legal practitioners: family law attorneys, mediators
• Ethical considerations and client confidentiality
• Review of key concepts and assessment

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
