This course provides financial services professionals with a comprehensive understanding of how the South African Constitution directly impacts the financial services industry. Course Outline

Day 1: Foundations of the SA Constitution and Its Relevance to Financial Services

Objectives:
• Understand the historical context and structure of the SA Constitution.
• Identify key constitutional principles that impact financial services.
• Recognize the Bill of Rights and its application to economic activity.
• Explain the role of constitutional bodies like the Public Protector and Human Rights Commission.

Topics:
• Overview of the SA Constitution: history, structure, and supremacy.
• The Bill of Rights: specific rights affecting financial services (e.g., equality, property, access to information).
• Constitutional principles: rule of law, accountability, and transparency.
• Impact on financial regulation: Promotion of Access to Information Act (PAIA), Promotion of Administrative Justice Act (PAJA).
• Role of Chapter 9 institutions in financial services oversight.

Day 2: Constitutional Rights in Financial Practice and Consumer Protection

Objectives:
• Apply constitutional rights to real-world financial scenarios.
• Analyze how consumer protection laws align with the Constitution.
• Evaluate the balance between rights and responsibilities in financial contracts.
• Understand the constitutional basis for fair lending and debt collection practices.

Topics:
• Equality and non-discrimination in credit provision and insurance.
• Right to privacy and data protection in financial services (POPIA).
• Access to information: disclosure requirements for financial products.
• Just administrative action: complaints handling and dispute resolution.
• Property rights and their limitations: repossession and foreclosure.
• Case studies: constitutional challenges in financial services (e.g., garnishee orders, reckless lending).

Day 3: Integrating Constitutional Compliance into Financial Services Operations

Objectives:
• Develop policies that embed constitutional values in financial institutions.
• Assess compliance risks using constitutional benchmarks.
• Design training and awareness programs for staff.
• Create a constitutional compliance action plan for a financial services context.

Topics:
• Constitutional compliance frameworks: aligning with FSCA, NCR, and Ombudsman requirements.
• The role of the Financial Sector Regulation Act (FSRA) in promoting constitutional objectives.
• Developing a constitutional compliance checklist for financial products and services.
• Ethical decision-making guided by constitutional principles.
• Reporting and accountability: whistleblowing and protected disclosures.
• Action planning: steps to embed constitutional awareness in daily operations.

Practicals

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

All marks are recorded on the AATICD LMS and visible to each learner under their account.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
