Course Outline

Day 1: Foundations of Court Messaging and Legal Documentation

Objectives:
• Understand the role and responsibilities of a court messenger within the South African judicial system.
• Identify key legal documents commonly handled by court messengers.
• Learn the principles of confidentiality, integrity, and professionalism in document handling.
• Recognize the importance of accurate record-keeping and service of process.
• Outline the legal framework governing court messaging, including relevant legislation.

• Introduction to the South African court system and hierarchy
• Role and ethical duties of a court messenger
• Types of legal documents: summonses, subpoenas, court orders, warrants
• Legal requirements for service of process (Rule 4 of the Uniform Rules of Court)
• Confidentiality and data protection principles
• Record-keeping: logs, affidavits of service, and returns of service
• Professional conduct and communication with court officials and the public
• Overview of the day's practical activities

Day 2: Practical Service Techniques and Documentation

Objectives:
• Demonstrate correct procedures for serving different types of legal documents.
• Apply rules for substituted service and service by publication.
• Complete service logs and affidavits of service accurately.
• Manage time and routes efficiently for multiple service points.
• Handle refusal of service, non-service, and other challenges professionally.

• Step-by-step service procedures for summonses, subpoenas, and court orders
• Substituted service: when and how to apply
• Service by publication: requirements and process
• Completing returns of service and affidavits
• Time management and route planning for multiple services
• Dealing with difficult situations: refusal, evasive parties, and safety
• Use of technology: GPS tracking, electronic logging, and mobile apps
• Practical exercises in mock service scenarios

Day 3: Advanced Procedures, Compliance, and Integration

Objectives:
• Understand service requirements for urgent applications and interdicts.
• Apply knowledge of jurisdictional rules and cross-border service.
• Comply with court rules and avoid common errors leading to disputes.
• Integrate record-keeping with court filing systems.
• Prepare for assessment and demonstrate competence in practical skills.

• Urgent applications and interim orders: service timelines and methods
• Service across provincial borders and into other countries
• Common errors in service: how to avoid them
• Court filing procedures and integration with case management systems
• Review of legal updates and case law affecting court messengers

Practicals

12 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions are essential for court messengers to develop hands-on skills in document service, route planning, and documentation. Learners will engage in simulated service scenarios, complete affidavits of service, and practice using technology for tracking and logging.

Practical Activities
  • Mock Service of Documents — Learners practice serving mock legal documents (summonses, subpoenas) on volunteers acting as recipients, including handling refusal and substituted service scenarios. (4h)
  • Route Planning and Time Management — Using a map and schedule, learners plan an efficient route for serving multiple documents within a given timeframe, then execute the plan in a simulated environment. (3h)
  • Documentation and Record-Keeping — Learners complete service logs, returns of service, and affidavits for multiple scenarios, ensuring accuracy and compliance with court requirements. (3h)
  • Integrated Service Simulation — A comprehensive simulation combining route planning, document service, and documentation under time pressure, with feedback from instructors. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

All marks are recorded on the AATICD LMS and visible to each learner under their account.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).

  • Each certificate is a branded PDF with the delegate's name, the course title, the unit standard ID, NQF level, credits, and the date of issue.

  • If you scored under 50% you can sit the final test again at the next scheduled session at no extra cost.
