Course Outline

Day 1: Foundations of HR Management and Labour Relations

Objectives:
• Understand the role and functions of HR management within an organisation
• Differentiate between individual and collective labour relations
• Identify key legislation governing employment in South Africa
• Recognise the structure and purpose of the Commission for Conciliation, Mediation and Arbitration (CCMA)

Topics:
• Introduction to HR management: strategic vs operational roles
• Overview of labour relations: parties, processes, and objectives
• Key South African labour legislation: Labour Relations Act, Basic Conditions of Employment Act, Employment Equity Act
• The role of the CCMA, bargaining councils, and labour courts
• Ethics and professional conduct in HR

Day 2: Recruitment, Selection, and Employment Contracts

Objectives:
• Design a fair and compliant recruitment and selection process
• Draft employment contracts that meet legal requirements
• Understand the implications of fixed-term and probationary appointments
• Apply employment equity principles in hiring decisions

Topics:
• Job analysis and job descriptions
• Recruitment methods and advertising
• Selection techniques: interviews, assessments, and reference checks
• Employment contracts: essential clauses, fixed-term, probation
• Employment equity planning and affirmative action

Day 3: Performance Management and Employee Relations

Objectives:
• Develop a performance management system aligned with organisational goals
• Conduct effective performance appraisals and provide constructive feedback
• Manage employee grievances and disciplinary processes lawfully
• Understand the concept of misconduct, incapacity, and poor performance

Topics:
• Performance management cycle: planning, monitoring, reviewing
• Performance appraisal methods and bias mitigation
• Grievance procedures: informal and formal resolution
• Disciplinary code and procedure: warnings, hearings, sanctions
• Managing incapacity: ill health and poor performance

Day 4: Collective Bargaining and Dispute Resolution

Objectives:
• Explain the process of collective bargaining and its legal framework
• Participate in negotiations effectively
• Identify different types of industrial action and their regulation
• Apply dispute resolution mechanisms including conciliation and arbitration

Topics:
• Collective bargaining: levels, topics, and bargaining councils
• Negotiation skills and strategies
• Trade unions: recognition, rights, and organisational rights
• Industrial action: strikes, lock-outs, and protected vs unprotected action
• Dispute resolution: CCMA processes, conciliation, arbitration, and Labour Court

Day 5: Strategic HR Planning and Integration

Objectives:
• Align HR strategy with organisational strategy
• Develop a basic HR plan including workforce forecasting
• Integrate labour relations principles into HR policies
• Prepare for an HR audit and compliance review

Topics:
• Strategic HR planning: forecasting demand and supply
• Talent management and succession planning
• HR policy development and implementation
• HR metrics and analytics
• Compliance audits and continuous improvement

Practicals

16 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions reinforce theoretical knowledge through role-plays, case studies, and simulated exercises. Learners engage in mock disciplinary hearings, grievance handling, collective bargaining negotiations, and drafting employment documents to build applied competence in HR and labour relations.

Practical Activities
  • Practical 1: Drafting Employment Contracts — Learners draft a compliant employment contract based on a given scenario, including essential clauses and probation provisions. (3h)
  • Practical 2: Conducting a Disciplinary Hearing — Learners role-play a disciplinary hearing, taking on roles of chairperson, employer representative, employee, and witness, following the LRA Code of Good Practice. (4h)
  • Practical 3: Grievance Handling and Mediation — Learners simulate a grievance process from informal discussion to formal mediation, practicing active listening and problem-solving. (4h)
  • Practical 4: Collective Bargaining Negotiation — Teams represent management and union in a mock negotiation over wage increases and working conditions, aiming to reach a collective agreement. (3h)
  • Practical 5: Performance Appraisal Role-Play — Learners conduct a performance appraisal interview using a provided appraisal form, giving constructive feedback and setting goals. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
