This course equips learners with the practical skills to correctly classify commodities according to the Harmonized System (HS) of customs tariff. Participants will gain the expertise to determine applicable duty rates, interpret tariff headings and subheadings, and ensure compliance with South African customs regulations. The course is essential for reducing import/export costs and avoiding penalties through accurate classification.

Target Audience

This course is designed for customs brokers, freight forwarders, import/export clerks, supply chain professionals, and trade compliance officers who are involved in the classification of goods for customs purposes.

Course Outline

Day 1: Introduction to Customs Tariff Classification

Objectives:
• Understand the purpose and structure of the Harmonized System (HS).
• Explain the role of tariff classification in international trade.
• Identify the key components of the SACU tariff book.
• Apply the General Rules of Interpretation (GIRs) 1-3.
• Distinguish between sections, chapters, headings, and subheadings.

Topics:
• Overview of customs tariff classification and its importance.
• The Harmonized System (HS) and its global adoption.
• Structure of the SACU tariff book (sections, chapters, headings, subheadings).
• Introduction to the General Rules of Interpretation (GIRs).
• GIR 1: Classification according to the terms of headings and section/chapter notes.
• GIR 2: Classification of incomplete, unfinished, or mixed goods.
• GIR 3: Classification of goods classifiable under multiple headings.
• Practical examples of simple classifications.

Day 2: Advanced General Rules of Interpretation and Legal Notes

Objectives:
• Apply GIRs 4-6 to complex classification scenarios.
• Interpret section, chapter, and subheading notes effectively.
• Use the alphabetical index to locate tariff headings.
• Classify goods using the “essential character” principle.
• Understand the hierarchy of rules and their application.

• GIR 4: Classification by analogy.
• GIR 5: Classification of containers and packing materials.
• GIR 6: Classification at the subheading level.
• Role of section and chapter notes.
• Using the alphabetical index and explanatory notes.
• Determining essential character (GIR 3(b)).
• Case studies on ambiguous classification.
• Common pitfalls in applying GIRs.

Day 3: Classification of Specific Commodity Groups

Objectives:
• Classify agricultural products, textiles, and machinery.
• Apply special classification rules for chemicals and plastics.
• Understand tariff treatment of electronic goods.
• Classify vehicles and parts thereof.
• Use binding tariff information (BTI) for guidance.

Topics:
• Section I: Live animals and animal products.
• Section II: Vegetable products.
• Section VI: Chemical products.
• Section VII: Plastics and rubber.
• Section XI: Textiles and textile articles.
• Section XVI: Machinery and mechanical appliances.
• Section XVII: Vehicles, aircraft, and vessels.
• Using binding tariff information (BTI).

Day 4: Tariff Classification and Trade Agreements

Objectives:
• Understand the impact of trade agreements on classification.
• Determine preferential tariff treatment under SADC, EU-SADC EPA, etc.
• Apply rules of origin in conjunction with classification.
• Classify goods for duty calculation and trade statistics.
• Interpret tariff quotas and anti-dumping duties.

Topics:
• Overview of South Africa's trade agreements.
• Preferential tariff treatment and certificate of origin.
• Rules of origin and their relationship to tariff classification.
• Duty calculation based on correct HS code.
• Tariff quotas and their classification implications.
• Anti-dumping and countervailing duties.
• Classification for trade statistics (SARS data).
• Case studies on preferential vs. MFN rates.

Day 5: Practical Integration and Compliance

Objectives:
• Conduct a complete tariff classification audit.
• Resolve classification disputes and rulings.
• Use SARS e-commerce systems for tariff classification.
• Apply penalties and compliance requirements.
• Develop a classification checklist for daily use.

Topics:
• Conducting a tariff classification audit.
• Requesting and interpreting tariff rulings.
• Using SARS online tools (e.g., Tariff Enquiry System).
• Managing classification disputes with customs.
• Compliance requirements and record-keeping.
• Penalties for misclassification.
• Best practices for maintaining classification accuracy.

Overview

Hands-on practical sessions are essential for mastering tariff classification skills. Learners will apply the General Rules of Interpretation to real-world product samples, use the SACU tariff book and online tools, and complete classification exercises that simulate actual customs scenarios.

Practical Activities
  • Practical 1: Navigating the Tariff Book — Learners use the SACU tariff book and alphabetical index to locate HS codes for a range of common products. (3h)
  • Practical 2: Applying General Rules of Interpretation — Learners classify ambiguous or multi-component products using GIRs 1-6, with group discussions on essential character. (4h)
  • Practical 3: Classification of Specific Commodities — Learners classify products from various sectors (e.g., textiles, machinery, chemicals) using explanatory notes and BTI. (4h)
  • Practical 4: Tariff Classification Audit and Compliance — Learners conduct a mini-audit of provided product codes, identify errors, and complete a classification checklist. (4h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
