Course Outline

Day 1: Foundations of Estate Planning

Objectives:
• Understand the legal framework for estate planning in South Africa.
• Identify key stakeholders and their roles in the estate planning process.
• Define high net worth clients and their unique estate planning needs.
• Explain the basic principles of wills, trusts, and estates.

Topics:
• Introduction to estate planning and its importance for HNW clients
• South African legal context: Wills Act, Intestate Succession Act, Administration of Estates Act
• Key players: executors, trustees, beneficiaries, financial advisors
• Characteristics of HNW clients: complex assets, cross-border issues, business interests
• Overview of wills: requirements, types, and limitations
• Introduction to trusts: inter vivos, testamentary, and special trusts

Day 2: Tax Implications and Estate Duty

Objectives:
• Calculate estate duty and understand applicable deductions.
• Analyse the impact of capital gains tax (CGT) on estate assets.
• Evaluate the use of donations and donations tax in estate planning.
• Identify tax-efficient strategies for wealth transfer.

Topics:
• Estate duty: rates, abatements, and deductions (Section 4A, 4B)
• Capital gains tax on death: primary residence exclusion, rollover relief
• Donations tax: annual exemptions, cumulative limits, and planning opportunities
• Income tax implications for trusts and estates
• Tax implications of life insurance policies and retirement funds
• Case studies: calculating estate duty and CGT for HNW estates

Day 3: Trusts and Business Succession Planning

Objectives:
• Differentiate between types of trusts and their applications.
• Design trust structures for asset protection and wealth preservation.
• Develop business succession plans for family-owned enterprises.
• Understand the role of buy-and-sell agreements and share schemes.

• Types of trusts: discretionary, vesting, special trusts (e.g., for persons with disabilities)
• Trust governance: trustees, letters of wishes, and trust deeds
• Asset protection: ring-fencing assets from creditors and divorce claims
• Business succession planning: continuity, management transition, ownership transfer
• Buy-and-sell agreements: funding mechanisms (life insurance, sinking funds)
• Share schemes for employees and family members (employee share ownership plans)

Day 4: Offshore Estate Planning and International Considerations

Objectives:
• Identify cross-border estate planning issues for HNW clients with foreign assets.
• Evaluate the use of offshore trusts and foreign wills.
• Understand double taxation agreements and their impact.
• Plan for exchange control regulations and repatriation of assets.

Topics:
• Cross-border assets: immovable property, investment portfolios, business interests
• Offshore trusts: jurisdiction selection, purpose, and regulatory compliance
• Foreign wills: recognition, conflict of laws, and probate
• Double taxation agreements: estate duty, CGT, and income tax relief
• Exchange Control Regulations (South African Reserve Bank): approvals, loop structures
• Practical case study: structuring a multi-jurisdiction estate

Day 5: Advanced Strategies and Implementation

Objectives:
• Design comprehensive estate plans incorporating advanced strategies.
• Integrate philanthropic goals and family governance into estate plans.
• Draft key clauses for wills and trust deeds.
• Present a complete estate plan to a mock client.

• Advanced strategies: life insurance trusts, charitable remainder trusts, family offices
• Philanthropy: foundations, donor-advised funds, and tax incentives
• Family governance: family charters, family councils, and succession protocols
• Drafting wills and trust deeds: key clauses, special bequests, and contingencies
• Reviewing and updating estate plans: triggers for change (marriage, divorce, new legislation)
• Case study: comprehensive estate plan for a HNW family with business, offshore assets, and philanthropic goals

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
