Day 2: Consumer Protection and Fair Trading Compliance

Objectives:
• Apply the Consumer Protection Act (CPA) to craft business transactions.
• Understand requirements for product labelling, warranties, and returns.
• Implement fair marketing and advertising practices.
• Handle customer complaints and disputes in compliance with the CPA.

Topics:
• Scope and application of the Consumer Protection Act 68 of 2008.
• Consumer rights: right to information, fair value, good quality, and safety.
• Plain language and disclosure requirements for contracts and labels.
• Warranties, implied warranties, and liability for defective goods.
• Cooling-off periods and cancellation rights.
• Handling returns, refunds, and exchanges.
• Prohibited conduct: false advertising, bait marketing, and unconscionable conduct.
• Complaint resolution mechanisms: NCC, ombudsman, and small claims court.

Day 3: Labour Law and Employment Compliance for Small Craft Businesses

Objectives:
• Understand basic employment rights and obligations under the Labour Relations Act and Basic Conditions of Employment Act.
• Draft compliant employment contracts and policies.
• Manage working hours, leave, and termination legally.
• Implement health and safety measures as per the Occupational Health and Safety Act.

• Key labour legislation: Labour Relations Act, Basic Conditions of Employment Act, Employment Equity Act.
• Essential clauses in an employment contract: duties, remuneration, working hours, leave.
• Minimum wage requirements and sectoral determinations.
• Leave entitlements: annual, sick, family responsibility, maternity.
• Termination of employment: notice periods, unfair dismissal, retrenchment procedures.
• Occupational Health and Safety requirements for small craft workshops.
• Record-keeping and compliance with UIF, COIDA, and Skills Development Levy.
• Handling disputes: CCMA processes and representation.

Day 4: Tax Compliance and Intellectual Property Protection

Objectives:
• Understand tax obligations for small craft businesses: income tax, VAT, and provisional tax.
• Register for tax and submit returns correctly.
• Protect intellectual property: trademarks, copyright, and designs.
• Avoid infringement and enforce rights.

• Overview of South African tax system: SARS, income tax, VAT, provisional tax.
• Registration requirements: income tax, VAT (thresholds), PAYE.
• Record-keeping for tax purposes: receipts, invoices, expense tracking.
• Filing returns: annual income tax, bi-annual VAT, provisional tax payments.
• Tax deductions and allowances for small businesses.
• Intellectual property basics: trademarks (registration and protection), copyright (automatic protection), registered designs.
• Steps to register a trademark with CIPC.
• Dealing with infringement: cease and desist, litigation.

Day 5: Integrating Compliance into Business Operations and Practical Assessment

Objectives:
• Develop a compliance checklist tailored to a small craft business.
• Create a simple compliance management plan.
• Apply knowledge to real-world scenarios and case studies.
• Demonstrate understanding through a practical assessment.

Topics:
• Building a compliance framework: policies, procedures, and monitoring.
• Compliance checklist for daily operations: contracts, labels, employee records, tax filings.
• Risk management: identifying and mitigating legal risks.
• Case studies: common compliance pitfalls for craft businesses.
• Role-play: handling a consumer complaint and a labour dispute.
• Practical assessment: participants complete a compliance self-audit for their own business or a simulated business.
• Review and feedback on assessment.
• Resources for ongoing compliance: government websites, legal advisors, industry associations.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
