Description

This course equips learners with the knowledge and skills to implement and manage employment equity in the workplace. It covers the legal framework, development of equity plans, and strategies to promote diversity and fair treatment. By the end, participants will be able to contribute to a transformed and inclusive organisational culture.

Course Outline

Day 1: Introduction to Employment Equity and the Legal Framework

Objectives:
• Understand the purpose and key provisions of the Employment Equity Act (EEA).
• Identify designated employers and their obligations under the EEA.
• Define prohibited grounds of discrimination and unfair discrimination.
• Explain the role of the Employment Equity Commission.

Topics:
• Overview of Employment Equity Act (No. 55 of 1998) and amendments.
• Purpose: redressing past disadvantages and promoting equal opportunity.
• Designated employers: criteria and responsibilities.
• Prohibited grounds of discrimination: race, gender, disability, etc.
• Affirmative action measures vs. unfair discrimination.
• Key institutions: Employment Equity Commission, Labour Court.
• Penalties for non-compliance.
• Case studies on unfair discrimination.

Day 2: Employment Equity Planning and Consultation

Objectives:
• Conduct an employment equity analysis of the workforce.
• Develop an Employment Equity Plan (EEP) with measurable objectives.
• Understand the consultation process with employees and unions.
• Identify barriers to affirmative action and strategies to remove them.

Topics:
• Workforce profile analysis: race, gender, disability representation.
• Identifying underrepresentation and barriers to equity.
• Developing an Employment Equity Plan: goals, timelines, responsibilities.
• Consultation requirements: employee representatives, trade unions.
• Reporting and monitoring progress.
• Reasonable accommodation for persons with disabilities.
• Drafting an EEP: practical exercise.
• Reviewing sample EE plans.

Day 3: Implementation of Affirmative Action Measures

Objectives:
• Implement affirmative action measures in recruitment, selection, and promotion.
• Design training and development programs to support equity.
• Manage diversity and create an inclusive workplace culture.
• Understand the role of numerical goals and targets.

Topics:
• Recruitment and selection: bias-free processes, targeted outreach.
• Training and development: skills programs, mentorship, bursaries.
• Promotion and succession planning: ensuring fair progression.
• Numerical goals and timetables: setting realistic targets.
• Diversity management: cultural sensitivity, inclusive policies.
• Retention strategies for designated groups.
• Case studies on successful implementation.
• Role-play: consultation meeting.

Day 4: Monitoring, Reporting, and Compliance

Objectives:
• Prepare and submit Employment Equity Reports (EERs).
• Conduct internal monitoring and audits of EE progress.
• Understand the role of the Department of Employment and Labour inspections.
• Identify consequences of non-compliance and remedial actions.

Topics:
• Annual reporting requirements: EEA2 and EEA4 forms.
• Income differentials statement: EEA3.
• Submission deadlines and online systems.
• Internal monitoring: tracking progress against plan.
• Audits and inspections by the Department of Employment and Labour.
• Non-compliance: fines, penalties, and name-and-shame.
• Remedial action plans.
• Practical exercise: completing EEA2 form.

Day 5: Advanced Topics, Integration, and Assessment

Objectives:
• Apply employment equity principles to complex scenarios.
• Integrate EE with other HR policies (e.g., skills development, B-BBEE).
• Evaluate the effectiveness of an EE program.
• Prepare for an EE audit or inspection.

Topics:
• Intersection with Skills Development Act and B-BBEE scorecard.
• Managing EE in a multi-site or unionised environment.
• Dealing with disputes and grievances related to equity.
• Best practices in employment equity: case studies.
• Review of recent amendments and court rulings.
• Final assessment: scenario-based case study.
• Course wrap-up and Q&A.

Practicals

16 hours of practicals To be conducted online or on-campus or in-house
Overview

Practical sessions allow learners to apply theoretical knowledge to realistic workplace scenarios. Learners will draft parts of an Employment Equity Plan, complete reporting forms, and participate in role-play consultations to build hands-on compliance skills.

Practical Activities
  • Workforce Profile Analysis — Learners analyse a sample workforce dataset to identify underrepresentation and barriers to equity. (4h)
  • Drafting an Employment Equity Plan — Using a template, learners develop an Employment Equity Plan with objectives, timelines, and responsibilities. (4h)
  • Role-Play Consultation Meeting — Learners simulate a consultation session between employer representatives and employee forum members to discuss the EE plan. (4h)
  • Completing Employment Equity Reports — Learners fill in EEA2 and EEA4 forms using a case study workforce data. (4h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
