Description

This course equips learners with a comprehensive understanding of the Employment Equity Act (No. 55 of 1998) and its practical application in the South African workplace. Participants will learn to develop, implement, and monitor employment equity plans to promote fairness and diversity. The course aims to foster compliance with legal requirements and contribute to the transformation of the workforce.

Course Outline

Day 1: Introduction to Employment Equity

Objectives:
• Understand the historical context and purpose of Employment Equity in South Africa.
• Identify key legislation: Employment Equity Act, Labour Relations Act, and Skills Development Act.
• Define designated groups and the concept of unfair discrimination.
• Recognise the role of the Employment Equity Commission.
• Explain the relationship between Employment Equity and transformation.

Day 2: Employment Equity Planning and Consultation

Objectives:
• Understand the process of conducting an Employment Equity analysis.

• Identify stakeholders and the consultation process.
• Set numerical goals and timetables for achieving representivity.
• Understand the role of employment equity committees.

• Conducting a workforce profile analysis.

• Setting measurable objectives and targets.

Day 3: Implementation of Affirmative Action Measures

Objectives:
• Distinguish between affirmative action and reverse discrimination.
• Identify fair and unfair discrimination in recruitment, selection, and promotion.
• Design inclusive recruitment and retention strategies.
• Understand reasonable accommodation for persons with disabilities.
• Apply principles of equal pay for work of equal value.

• Recruitment strategies to attract designated groups.
• Selection and promotion without bias.
• Retention and development of designated groups.

Day 4: Monitoring, Reporting, and Compliance

Objectives:
• Understand the reporting requirements under the Employment Equity Act.
• Learn to complete and submit the Employment Equity report (EEA2/EEA4).
• Identify compliance obligations and penalties for non-compliance.
• Conduct internal audits and review progress.
• Understand the role of labour inspectors and the CCMA.

• Annual reporting: EEA2 and EEA4 forms.
• Income differentials statement.
• Compliance assessments and enforcement.

• Conducting an Employment Equity audit.
• Reviewing and updating the Employment Equity Plan.

Day 5: Integrating Employment Equity into Organisational Strategy

Objectives:
• Align Employment Equity with B-BBEE scorecard and transformation strategy.
• Develop an integrated Employment Equity, Skills Development, and Talent Management plan.
• Manage resistance to change and foster an inclusive culture.
• Evaluate the impact of Employment Equity interventions.
• Create a sustainable Employment Equity implementation roadmap.

This course is made up of exercises and case studies delivered alongside the theory — no separate practical sessions are required to complete it.

Summatives

Each delegate is assessed continuously throughout the course and a final summative test at the end.

Daily Exercises — 30%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 30% to the final total.

Final Test — 70%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 70% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Daily Average 30% + Final Test 70%).
