This course equips learners with a foundational understanding of collective bargaining theory, enabling them to analyse the dynamics of labour relations within the South African context. It covers the principles, processes, and legal frameworks that underpin collective bargaining, preparing participants to engage effectively in negotiations and dispute resolution.

Course Outline

Day 1: Introduction to Collective Bargaining

Objectives:
• Define collective bargaining and its role in labour relations
• Understand the historical and legal context of collective bargaining in South Africa
• Identify key stakeholders in the bargaining process
• Explain the purpose and outcomes of collective bargaining

Topics:
• Definition and principles of collective bargaining
• Historical development of collective bargaining in South Africa
• Legal framework: Labour Relations Act, 1995
• Roles of employers, unions, and employees
• Types of collective bargaining: distributive, integrative, and productivity bargaining

Day 2: Legal and Institutional Framework

Objectives:
• Describe the structure and functions of bargaining councils
• Understand the process of dispute resolution
• Explain the role of the CCMA and Labour Courts
• Identify key provisions of collective agreements

Topics:
• Bargaining councils: establishment, scope, and functions
• Statutory councils and their role
• Dispute resolution mechanisms: conciliation, mediation, arbitration
• Role of the CCMA and Labour Courts
• Content and enforcement of collective agreements

Day 3: Bargaining Strategies and Tactics

Objectives:
• Differentiate between various bargaining strategies
• Apply negotiation tactics effectively
• Understand power dynamics in collective bargaining
• Prepare for negotiations using interest-based approaches

Topics:
• Distributive vs. integrative bargaining
• Negotiation tactics: positioning, concessions, and persuasion
• Power resources: strikes, lockouts, and bargaining power
• Interest-based bargaining and mutual gains
• Preparation and planning for negotiations

Day 4: The Bargaining Process and Communication

Objectives:
• Outline the stages of the collective bargaining process
• Demonstrate effective communication and interpersonal skills
• Handle difficult negotiations and conflict resolution
• Understand the role of mandates and caucusing

• Stages of bargaining: pre-negotiation, negotiation, and post-negotiation
• Communication skills: active listening, questioning, and feedback

Day 5: Collective Agreements and Implementation

Objectives:
• Analyse the components of a collective agreement
• Understand the implementation and enforcement of agreements
• Address common challenges in agreement administration
• Evaluate the impact of collective agreements on workplace relations

• Structure and content of collective agreements
• Wages, working conditions, and benefits clauses
• Grievance procedures and dispute resolution clauses
• Implementation challenges: interpretation, compliance, and monitoring
• Impact of collective agreements on productivity and labour relations

Day 6: Advanced Topics and Practical Integration

Objectives:
• Explore emerging trends in collective bargaining
• Integrate knowledge through simulated bargaining exercises
• Develop a personal action plan for effective bargaining
• Assess the role of collective bargaining in organisational strategy

• Trends: decentralised bargaining, sectoral bargaining, and social dialogue
• International perspectives on collective bargaining
• Simulated bargaining exercise: preparation, negotiation, and debrief
• Ethics and good faith bargaining
• Developing a bargaining strategy for your organisation

Overview

Practical sessions reinforce theoretical concepts through role-play negotiations, drafting collective agreement clauses, and simulated dispute resolution. Learners apply strategies and communication skills in realistic scenarios, building competence in bargaining processes.

Practical Activities
  • Practical 1: Negotiation Role-Play — Learners participate in a simulated collective bargaining session, representing either management or union, negotiating a wage agreement. (6h)
  • Practical 2: Drafting a Collective Agreement Clause — Learners draft a specific clause (e.g., grievance procedure or wage structure) for a collective agreement based on a given scenario. (4h)
  • Practical 3: Dispute Resolution Simulation — Learners simulate a conciliation or arbitration process, presenting arguments and seeking resolution for a workplace dispute. (4h)
  • Practical 4: Bargaining Strategy Presentation — Learners develop and present a bargaining strategy for a hypothetical negotiation, justifying their approach. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
