Description

This course equips trade union representatives and labour practitioners with a comprehensive understanding of the legislative framework governing collective bargaining in South Africa. Participants will gain the knowledge and skills to effectively participate in collective bargaining processes within the context of the Labour Relations Act and related legislation.

The course is designed for trade union shop stewards, officials, and labour relations practitioners who are involved in or preparing for collective bargaining negotiations. It is also suitable for employee representatives seeking to deepen their understanding of the legal framework.

Course Outline

Day 1: Foundations of Collective Bargaining and Labour Law

Objectives:
• Explain the purpose and scope of collective bargaining in South Africa.
• Identify the key legislative sources governing labour relations.
• Describe the roles of the Commission for Conciliation, Mediation and Arbitration (CCMA) and Labour Courts.
• Define trade unions, employer organisations, and workplace forums.
• Outline the constitutional framework for labour rights.

Topics:
• Overview of the Labour Relations Act (LRA) and its objectives.
• Constitutional provisions: Section 23 and 27.
• Key institutions: CCMA, Labour Court, Labour Appeal Court.
• Definition and registration of trade unions and employer organisations.
• Types of collective bargaining: centralised, decentralised, and plant-level.
• Bargaining councils and statutory councils.
• Organisational rights: access, stop-order, shop stewards, and leave.
• Introduction to collective agreements and their legal effect.

Day 2: The Collective Bargaining Process and Legal Requirements

Objectives:
• Explain the steps in the collective bargaining process.
• Identify mandatory and permissive subjects of bargaining.
• Describe the legal requirements for a valid collective agreement.
• Analyse the duty to bargain in good faith.
• Understand the role of dispute resolution in bargaining.

Topics:
• The bargaining process: preparation, negotiation, and agreement.
• Subjects of bargaining: wages, working hours, leave, and benefits.
• Legal requirements for collective agreements: in writing, signed, and registered.
• Good faith bargaining and unfair labour practices.
• Dispute resolution mechanisms: conciliation, mediation, and arbitration.
• Strike and lockout provisions under the LRA.
• Essential and maintenance services.
• Picketing rules and conduct.

Day 3: Collective Agreements, Enforcement, and Dispute Resolution

Objectives:
• Interpret and draft clauses of a collective agreement.
• Explain enforcement mechanisms for collective agreements.
• Describe the dispute resolution process in detail.
• Analyse case law on collective bargaining disputes.
• Understand the role of the CCMA and Labour Courts in enforcement.

Topics:
• Structure and content of collective agreements: scope, duration, and termination.
• Enforcement of agreements: compliance orders and arbitration awards.
• Dispute resolution process: referral, conciliation, and arbitration.
• Labour Court applications: review and enforcement.
• Case studies: interpretation of collective agreements.
• Unfair dismissal disputes related to collective bargaining.
• Transfer of contracts and section 197 of the LRA.
• Bargaining council agreements and extension to non-parties.

Day 4: Strategic Bargaining, Current Trends, and Practical Application

Objectives:
• Develop a negotiation strategy for collective bargaining.
• Analyse current trends affecting collective bargaining in South Africa.
• Apply legislative framework to real-world scenarios.
• Evaluate the impact of economic and political factors on bargaining.
• Prepare for collective bargaining negotiations.

Topics:
• Strategic negotiation: interests, positions, and BATNA.
• Economic factors: inflation, productivity, and wage curves.
• Sectoral determinations and national minimum wage.
• Recent amendments to the LRA and case law.
• Multi-employer bargaining and coordination.
• Role of trade unions in transformation and employment equity.
• Future of collective bargaining: technology and gig economy.
• Mock bargaining exercise: simulation of collective negotiation.

Overview

Practical sessions reinforce the theoretical legislative framework through simulated collective bargaining exercises, dispute resolution role-plays, and drafting of collective agreement clauses. Learners apply their knowledge in realistic scenarios to develop practical negotiation and dispute resolution skills.

Practical Activities
  • Simulated Collective Bargaining Negotiation — Learners participate in a mock collective bargaining session representing either trade union or employer, negotiating wages and working conditions. (3h)
  • Dispute Resolution Role-Play — Learners simulate a dispute referral to the CCMA, including conciliation and arbitration processes. (3h)
  • Drafting and Reviewing Collective Agreement Clauses — Learners draft and critique clauses for a collective agreement, focusing on legal compliance and clarity. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
