Description

This course equips learners with the skills to plan and conduct negotiations that advance the interests of workers within the South African labour relations framework. Participants will learn to apply negotiation strategies, manage conflicts, and achieve outcomes that benefit workers while maintaining productive workplace relationships.

Target Audience

This course is designed for trade union representatives, shop stewards, employee representatives, and human resources practitioners who are involved in collective bargaining or workplace negotiations on behalf of workers.

Course Outline

Day 1: Introduction to Workplace Negotiations

Objectives:
• Understand the purpose and scope of workplace negotiations.
• Identify key stakeholders and their interests in negotiation processes.
• Differentiate between distributive and integrative negotiation approaches.
• Recognise the legal and regulatory framework governing negotiations in South Africa.

Topics:
• Definition and importance of workplace negotiations.
• Types of negotiations: distributive vs. integrative.
• Key role players: employers, employees, unions, and bargaining councils.
• Overview of relevant labour legislation (LRA, BCEA, EEA).
• Ethical considerations in negotiations.
• Introduction to negotiation outcomes and agreements.

Day 2: Negotiation Principles and Strategies

Objectives:
• Apply core negotiation principles such as BATNA, reservation price, and ZOPA.
• Develop negotiation strategies aligned with worker interests.
• Analyse power dynamics and their impact on negotiation outcomes.
• Prepare effectively for a negotiation session.

Topics:
• Understanding BATNA, reservation point, and ZOPA.
• Strategy formulation: competitive, collaborative, compromising.
• Power analysis: sources of power and balancing tactics.
• Pre-negotiation preparation: information gathering and goal setting.
• Interest-based bargaining techniques.
• Role of mandates and mandates in collective bargaining.

Day 3: Communication and Interpersonal Skills

Objectives:
• Demonstrate effective verbal and non-verbal communication in negotiations.
• Use active listening and questioning techniques to uncover interests.
• Manage emotions and build rapport with counterparts.
• Handle difficult conversations and conflict constructively.

Topics:
• Communication models and barriers.
• Active listening and paraphrasing.
• Assertiveness vs. aggression.
• Non-verbal cues and body language.
• Emotional intelligence and self-regulation.
• Techniques for de-escalating tension.
• Building trust and credibility.

Day 4: Negotiation Process and Tactics

Objectives:
• Outline the stages of a negotiation process from opening to closure.
• Identify common negotiation tactics and countermeasures.
• Apply principled negotiation techniques.
• Document and manage negotiation progress effectively.

Topics:
• Stages of negotiation: preparation, opening, exploration, bargaining, closure.
• Tactics: anchoring, bluffing, good cop/bad cop, nibbling.
• Counter-tactics and ethical boundaries.
• Principled negotiation (Harvard model).
• Managing concessions and trade-offs.
• Minute-taking and recording agreements.

Day 5: Collective Bargaining and Worker Representation

Objectives:
• Understand the collective bargaining process and its legal basis.
• Analyse the role of trade unions and worker representatives.
• Negotiate terms related to wages, hours, and working conditions.
• Address issues of retrenchment, restructuring, and grievance handling.

Topics:
• Collective bargaining structures (centralised vs. decentralised).
• Bargaining councils and statutory councils.
• Union recognition and organisational rights.
• Negotiating substantive issues: wages, benefits, hours.
• Procedural issues: discipline, grievances, retrenchment.
• Strike and lockout dynamics.
• Dispute resolution mechanisms (CCMA, Labour Court).

Day 6: Advanced Negotiation Scenarios

Objectives:
• Handle multi-party and multi-issue negotiations.
• Negotiate in high-stakes or crisis situations.
• Apply cross-cultural negotiation considerations.
• Use mediation and facilitation techniques when negotiations stall.

Topics:
• Multi-party negotiations: caucuses and coalitions.
• Crisis negotiations: deadlines, ultimatums, and walkouts.
• Cross-cultural negotiation: South African diversity context.
• Mediation and third-party intervention.
• Impasse resolution strategies.
• Ethics in complex negotiations.
• Case studies of real-world negotiations.

Day 7: Implementation, Evaluation, and Practical Integration

Objectives:
• Draft and finalise negotiation agreements.
• Evaluate negotiation outcomes and processes.
• Develop a personal action plan for future negotiations.
• Integrate learning through simulated negotiation exercises.

• Agreement drafting and ratification.
• Post-negotiation evaluation and debriefing.
• Feedback and continuous improvement.
• Building long-term relationships.

Overview

Practicals are integral to this course as they allow learners to apply negotiation theories and strategies in realistic, simulated workplace scenarios. Through role-plays, case studies, and guided exercises, learners develop hands-on skills in communication, bargaining, and conflict resolution essential for representing worker interests effectively.

Practical Activities
  • Simulated Negotiation: Wage and Benefit Dispute — Learners participate in a mock bargaining council session where they negotiate wage increases and benefit improvements for a unionised workforce. (6h)
  • Role-Play: Retrenchment Consultation — Learners act as union representatives negotiating retrenchment terms with management, focusing on severance packages and alternatives to dismissal. (5h)
  • Multi-Party Negotiation: Workplace Restructuring — Learners engage in a complex negotiation involving multiple stakeholders (union, management, employees) over restructuring and job grading. (5h)
  • Mediation and Impasse Resolution Exercise — Learners practice mediation techniques to resolve a deadlocked negotiation over shift changes and overtime pay. (3h)
  • Final Integrated Negotiation Simulation — Learners conduct a full negotiation from preparation to closure, integrating all skills learned, with peer and facilitator feedback. (2h)

Summatives

Each delegate is assessed continuously throughout the course via daily exercises, scored practical assignments, and a final summative test at the end.

Practical Assignments — 30%

Practical assignments are observed and scored against a rubric during the practical sessions. Each delegate's practical mark is averaged into a single 100% score and contributes 30% to the final total.

Daily Exercises — 20%

Every training day ends with a multiple-choice exercise scored out of 100%. The scores from each daily exercise are averaged across the duration of the course to produce a Daily Average mark, which contributes 20% to the final total.

Final Test — 50%

On the last day a final summative test is written. It is a multiple-choice paper with multiple-answer questions: each question may have more than one correct option, and a single wrong selection on a question marks the entire question wrong — no partial credit. The final test is scored out of 100% and contributes 50% to the overall mark.

Certificate of Completion

Awarded to delegates who achieve an overall mark of 50% or higher on the Final Total (Practicals 30% + Daily Average 20% + Final Test 50%).
